Ntional seminar on “25 YEARS OF PANCHAYATI RAJ SYSTEM IN INDIA: ISSUES AND CHALLENGES”

TWO-DAY NATIONAL SEMINAR TO BE ORGANIZED ON 18TH AND 19TH AUGUST 2017 BY THE

CENTRE FOR REGULATORY STUDIES, GOVERNANCE AND PUBLIC POLICY AT THE WEST

BENGAL NATIONAL UNIVERSITY OF JURIDICAL SCIENCES, KOLKATA

I. INTRODUCTION AND BACKGROUND

The Panchayati Raj system in India is one of the unique and sought-after institutional frameworks that not only supports effective management of resources through democratic decentralization but also promotes knowledge creation and capacity building through training and other organised activities. The Gram Panchayats, Panchayat Samitis and Zila Parishads are the three independent tiers within the Panchayati Raj framework. All the three tiers of local self-governance take part in participatory planning, in institutional development, in resource mobilization and, most importantly, in the administration and effective implementation of rural development schemes and programmes. Even though the Panchayati Raj Institutions (PRIs) seem to be a gift of modern democracy, in reality, they have been existing since centuries. If we look through the lens of history, we see that similar institutions existed in the time of Rig Vedas (1700 BC), in form of self-governing village bodies named „Sabhas.‟ The importance of the Sabhas can also be seen in the great epic Mahabharata in the form of „Panchala Kingdom,‟ which was a mahajanapada of ancient India. The name Panchala janapada indicates that it was a mix of Five Janas. Furthermore, the system of Janapada, flourished between 1500 BCE and 500 BCE. Arguably, the earliest mention of the term „Janapada‟ occurs in the Aitareya and Shatapatha Brahmana texts. Over time, these Janapadas evolved to be Panchayats, which was a council of five persons. These Panchayats were productive institutions responsible for local governance and administration. They had wide powers, both executive and judicial. Land wasdistributed by the Panchayats, which also collected taxes out of the produce and paid the government‟s share on behalf of the villages. These institutions existed for centuries (albeit in different forms) although, arguably, during the Mughal and British regimes there were signs of erosion of these institutions. The early 20th century marked a revival of these institutions and the British policy of „divide and rule‟ eventually made way for political decentralization.

The importance of local self-government found its demand with the Royal Commission on Decentralization in 1907 under C.E.H. Hobhouse, where the commission recommended: “it is most desirable, alike in the interests of decentralization and in order to associate the people with the local tasks of administration, that an attempt should be made to constitute and develop village Panchayats for the administration of local village affairs.” The observations of the Commission were further consolidated with the introduction of the Montague-Chelmsford reforms in 1919 that tried to bring the Panchayat system as a provincial transferred subject, under the domain of Indian ministers in the provinces. By 1926, eight provinces of British India had passed Panchayat acts and six native states had passed Panchayat laws. The Panchayats in India eventually evolved under the Government of India Act, 1935. In the Constituent Assembly debates, especially the one that was held on 19th November, 1949, lively discussions on the pros and cons of the Panchayat System ensued. Because of that, a directive to the state came in the form of Article 40 of the Indian Constitution. Article 40 reads, “The State shall take steps to organize village Panchayats and endow them with such powers and authority as may be necessary to enable them to function as units of self-government.”

In independent India, the system was introduced in October, 1959 in Naguar district of Rajasthan pursuant to the recommendations of the Balwantrai Mehta Committee, 1957. Apart from the Balwantrai Mehta Committee, several other committees and commissions were instituted to look into the functional autonomy of the Panchayati Raj framework. The 73rd Constitutional Amendment Act, 1992 formalized the framework by creating PRIs as institutions of local governance. Vide the 73rd Amendment, a new Part (Part IX) was appended to the Constitution and new articles defining gram sabhas, composition of Panchayats, reservation of seats, etc., were added. Since the Amendment, almost all states except Nagaland, Meghalaya and Mizoram adopted the system. As of today, the PRIs are enabling foundations supporting the cause of bottom-up development and institutional capacity building at the grass-roots level.

Day 1: The State of Comparative Law in Asia

Comparative law in Asia or about Asia has often been about comparing Europe or the United States with Asia, with very little intra-Asian comparisons. Either through colonisation or in fewer cases through so-called “modernisation”, almost all Asian jurisdictions have had to abandon most of their own legal traditions in most civil and commercial matters and receive some Western law as the most important formal component of their legal system.  This process has led to contacts and comparisons between the Asian jurisdictions and their former colonising country or the Western country from which they borrowed most of their laws. In private law, Japan for example had most of its comparative work done with Germany, Singapore with England, etc.  In civil law jurisdictions, that comparative law exercise was extremely rarely done in English.

There have also been many instances where civil law Asian jurisdictions have borrowed concepts and institutions from common law jurisdictions, for example from the United States, whether voluntarily or as impositions, for example by the Americans in Japan after WWII or by the IMF as so-called “conditionalities” for rescue packages during the Asian financial crisis in the late 1990s.  This has led to academic work comparing Asian civil law jurisdictions mainly with non-Asian common law jurisdictions.  In addition, probably because English is now the most widely spoken European language among young educated Asians; many young academics from Asian civil law jurisdictions have pursued their graduate studies in Western common law countries rather than in Western civil law countries.  This leads to common law concepts and solutions slowly osmosing into Asian civil laws.  This also leads to young Asian colleagues being more interested in comparing their civil law jurisdiction to the Western common law countries where they have studied rather than to Western civil law countries, or to any Asian country for that matter.

Now, however, with the increase of trade and exchanges within Asia and attempts at further economic integration, there is a need for more comparative work to be undertaken between Asian nations and between Asian traditions.  Some of this work has started, but much remains to be done.  This is the most interesting phenomenon to be studied.  First how much of this is happening? And given that not much of this is happening, how could we encourage more intra-Asian comparative law.

There is also a need to compare different legal traditions which are often present within the same Asian country.  For example, Indonesia has adat (indigenous laws), Islamic law and civil law in the Dutch/French tradition, yet these three traditions are too often studied separately and are rarely compared.  What is the state of “intra-jurisdictional” comparative law in legally pluralistic countries of Asia (India, Indonesia, Malaysia, Singapore etc.)?

This one day conference will look at all three aspects: (1) the state of comparative scholarship between Asian law and European/US law; (2) the state of intra-Asian comparative law; and (3) the state of “intra-jurisdictional” comparisons within legally pluralistic Asian countries.

Day 2:  Teaching Comparative Law in Asia

The second day will focus on the teaching of comparative law in Asia.  Two kinds of papers could be presented.

The first type would ask what comparative law courses are taught in the law schools of our different jurisdictions and how is comparative law taught.  Is there a general course on comparative law, is it compulsory, what does it cover (many legal traditions such as Islamic law and Hindu law or only the other Western tradition – civil law in common law jurisdictions, common law in civil law jurisdictions)? What materials are used (translations in a national or official language or materials in foreign languages)? Are there instances where two different legal traditions are taught to the same students but without adopting a comparative approach (e.g., students taking completely separate courses on Islamic family law and civil law family law). Are there advanced courses offering a comparative approach in a specific field of law (comparative corporate law, comparative constitutional law)? Is your school offering any course on the law of other Asian countries?

The second type of papers would focus on how we should ideally teach comparative law in Asia.  Do we need to create casebooks, maybe in English, focusing on Asian law (most comparative law textbooks focus on Western jurisdictions)?  How can our law school recruit colleagues who can teach comparative law or teach a given topic comparatively?  Should joint or exchange programmes (for student or even professors) be considered? Should our schools grant double degrees in civil and common law or in civil and Islamic law for example?

Shweta Sharma the paraathelete.

She is an true inspiration, an international medalist. We are glad to share her story wid you all.

1.How did u decided to choose paraathelete as your career?

I was not in sports line from childhood, from beginning my interest was in arts and crafts . Before marraige I was a teacher of arts and crafts in school and colleges. Then I got marraied and afterwards my two child borned, but unfortunately we can came up with several issues in our marriage and i got seprated from my husband, then I decided to came back at my parents home at that time I was having nothing to do because after marriage I left arts and craft also,  I got stuck with the puzles of my life. Then all of sudden, I came to know about para sports where the people like me can participate. And how this became a turning point for my life. Therefore I decided to choose paraathelete as my career.

2.What difficulties you faced initially when you came jn the field of sports and how you overcome it?
When I came in the field of the sports, I was unkown to everything and in field like sports we should have knowledge,  equipments,  full information,  but my financial was not good,  that I could arrange things for me. So, it was the most difficult thing for me to cope with my financial problems. I was already having the responsibility of two childs,  but because of my freinds and Geeta Malik(para player, international medalist),  I started taking training in youtube with help of my friends. After these several issues come but because  with support of public,  I played my first national in 2016 and i took part in shotput and javelins and i got one gold and one silver.

3. Did you get the supports from you parents and society when they come to know that you want to be a sportsperson?

Intially it was shocking for everyone beacuse i was never involved in a field of sports before. And my parents was asking me to think again for it, as at that time very few people were aware about para sports,  they were like how you will manage the things,  how will you go,  you have kids too how can you live them alone,  what about the finance and its a long process,  and all and all. But when I got my gold l, things got change i started getting suport from my parents and society. And the one of the important reason of my sucess is public support.

4. Any incident, experience you wpuld like to share wirh us?

This journey was very difficult for me, but though even I was determined. I came uo with many problems in my life amd soo much if difficulties,  but my love for my kids took me here todatoday.  I wanna to set myself to be an example for my child.  I did power lifting and i got partial tear in my back, doctor ask me to leave this otherwise I will lose my hand. Then i got selected in international match at China,  but i was not able to go because of financial conditions, i left all hope but I got arrangements from a NGO and i got first international medal.

5. What massage you want to give to women’s all around the nation so that they can also proceed towards their goals.

Foe everything we should have determination and hope that we should always kee. If a girl like me can do then anyone can. I was having several problems but still I am fighting and I will always,  everyone should keep this spirit. And we women’s are very strong we can do everything.

ST. XAVIER’S COLLEGE, JAIPUR IN ASSOCIATION WITH THE INDIAN ECONOMETRIC SOCIETY (TIES) ORGANIZES NATIONAL CONFERENCE

ABOUT THE CONFERENCE

India has been predominantly an agriculture based economy, where more than half of its work force depend on agriculture for their living. While the share of agriculture in gross domestic product has substantially declined over the years, a similar but rather slow decline has been seen in dependence of workforce on agricultural sector, resulting in a slow growth in the incomes of those dependent on agriculture for their livelihoods. With the change in farming practices over the years, regional disparities with respect to crop output, decline in poverty have resulted in rising inequalities. A precondition for rural development is advances in management and entrepreneurship in agriculture & agri-business as well as in value addition and linkages within agriculture and to non-agriculture sectors. Appropriate policies in these areas (governments, development agencies, donors and multinational companies)must be implemented to ensure rural economic development.

ABOUT THE COLLEGE

The Jaipur Xavier Educational Association (JXEA) was established in 1950, as a trust managed by the Jesuits. In 2006 the foundation of Xavier Vocational Institute (XVI) was laid in Jaipur to provide vocational training to the economically challenged sections of society. In 2010 the JXEA, in collaboration with the Xavier Alumni Association initiated the Higher Education Program and established the St. Xavier’s College, Jaipur, affiliated to the University of Rajasthan. The college is maintained by the members of the Delhi province of the Society of Jesus. St. Xavier’s, Jaipur has been making rapid strides in its pursuit of excellence at par with other Jesuit institutions of higher learning, since its inception. The skills and knowledge that is needed in the 21st century in the global context are being imparted with a broad- based academic curriculum.

THE INDIAN ECONOMETRIC SOCIETY (TIES)

The Indian Econometric Society (TIES) is a registered society under Public Societies Registration Act, formed in 1960. It is the oldest and largest body of professional econometricians and quantitative economists with more than 2000 members from all over India and abroad. It has provided a forum for economists, mathematicians and statisticians of India and abroad; to promote development of econometric methodology and techniques. TIES also publish half-yearly ‘Journal of Quantitative Economics’ released in the months of January and July.

CONFERENCE OBJECTIVE

The main aim of this conference is to provide an open, multi-disciplinary platform for thinkers,

academicians, national and international scientists, economists, business leaders, politicians and social

activists to debate and share their thoughts, ideas, views and address the challenges faced by India on

the topic “Agriculture and Rural Management: Prospects and Emerging Issues”. The conference

objective is to provide a platform for a cross section of researchers with varied disciplines contributing

applied and analytical papers, which need not necessarily, include econometric modeling. The aim of

the conference is also to connect thoughts and experiences on Agriculture & Rural Development and to

publish the selected papers in an edited volume. The programme will include keynote addresses, panel

discussions by leading experts, presentations by researchers and practitioners, informal conversations

and dialogues for mutual enrichment.

CONFERENCE THEMES

The conference committee, invites original and unpublished research papers from academicians, corporate delegates, research scholars and students addressing the conference

theme on one of the following themes:

 Agriculture and Finance

Due to inadequate financial resources and absence of timely credit facilities at reasonable rates, many of the farmers, even though otherwise willing, are unable to go in for improved seeds and manures and better methods or techniques. It can be further divided into following sub-themes:

o Agricultural Credit

o Microfinance

o Agriculture Insurance

o Issues on Agriculture Subsidy

 Agricultural Marketing

It is important to develop a market intelligence system which attempts to provide information on prices, arrivals, availability, trends, analysis, laws, etc. It requires a reliable programme which collects and disseminates accurate and useful information in farmer friendly manner. It can be further divided into following sub-themes:

o Agro-Industries and Rural Marketing

o Agriculture Food Processing and Marketing

o Recent Innovations and Use of Technology in Marketing

o Trading of Agriculture Produce

 Agriculture and Climate Change

During a period of climate change, maintaining crop production to feed a growing population is the greatest challenge we face as a species. It will focus on the likely impact of climate change on crop production, introduction of new technologies and explore approaches to maintain and increase crop productivity for the future demand. It can be further divided into following sub-themes:

o Agricultural Growth, Productivity and Production Diversification

o Change in Agriculture Technology and Use of Agriculture Inputs

o Ecology and Agro Climatic Changes

o Environmental Issues and Sustainable Agricultural Production

 Rural Management and Inclusive Growth Issues related to Heath, Poverty, Employment, Income disparities and Suicides by cultivators and agricultural labourers have now become general phenomenon in rural India. This unprecedented phenomenon is caused by a multi-dimensional crisis of the rural economy in the post greenrevolution phase of agricultural development. A combination of economic factors such as, economic hardship of the pauperized peasant households, crop failure, unemployment and indebtedness has pushed the victims to end. This theme can be further divided into following sub-

themes:

o Health, Malnutrition and Hunger

o Farmer Distress, Poverty and Disparities

o Employability and Employment Generation in Rural India

o Transformation in Farming System

 Post Production Issues in Agriculture

With mechanization, input structure of farm sector changes (i.e. increased use of modern inputs

such as HYV seeds, biotechnology, farm chemicals, fertilizers, implements, irrigation etc)., leading

to corresponding increase in marketed surplus. Technological progress leads to commercialization

of the farm economy, also production and consumption linkages get a boost. This also raises the

agricultural demand for off-farm services such as trading services, storage, transportation,

communication etc. for the distribution and marketing of inputs and outputs. This theme can be

further divided into following sub-themes:

o Food Security, Procurement and Changing Consumption Pattern

o Agriculture Storage, Supply Chain Management and Transportation Issues

o Agricultural Prices and Taxation

o Evaluation of Policies for Agriculture Development

 Global Scenario and Indian Agriculture

Trade liberalisation would lead to specialisation of resource use in accordance with the regional comparative advantages. However, crop specialisation due to free trade will be guided more by global price signals than long term efficiency considerations. Due to climate change and globalisation, global food security has become a vital issue. This theme can be further divided into following sub-themes:

o Trade in Agricultural Produce, WTO and Emerging Issues on Agriculture

o Terms of Trade and Global Agriculture Prices

o Agricultural Growth in Third World and Developed Countries

o Global Agriculture Production and Food Security

The 10th Eco-generation Environmental Essay Competition

Samsung Engineering jointly with UN Environment would like to launch “The 10th Eco-generation Environmental Essay Competition” inviting the youth all over the world to raise awareness on the theme of the upcoming World Environment Day – Connecting People to Nature.

As many of you know, World Environment Day is the United Nations’ flagship day for encouraging worldwide awareness and action for the environment. Over the years, it has grown to be one of the largest global platforms for public outreach celebrated by over a million of people in well over 100 countries. Hosted by Canada, this year’s World Environment Day has the theme Connecting People to Nature, and the slogan, “I’m With Nature.” The idea that underpins this is that in our modern world few of us take enough time away from our daily lives to appreciate and engage with our magnificent natural world. By celebrating World Environment Day surrounded by this beauty, we can rediscover the importance of caring for the environment so that it can care for us.
To commemorate WED and its annual theme, Eco-generation would like to celebrate the bigger and better WED than ever and to call on Tunza Eco-generation members around the world to show their love and affection for our shared natural world with an environmental essay.
The value of nature
In recent decades, scientific advances as well as growing environmental problems such as global warming are helping us to understand the countless ways in which natural systems support our own prosperity and well-being.
For example, the world’s oceans, forests and soils act as vast stores for greenhouse gases such as carbon dioxide and methane farmers and fisher-folk harness nature on land and under water to provide us with food scientists develop medicines using genetic material drawn from the millions of species that make up Earth’s astounding biological diversity.
Billions of rural people around the world spend every working day ‘connected to nature’ and appreciate full well their dependence on natural water supplies and how nature provides their livelihoods in the form of fertile soil. They are among the first to suffer when ecosystems are threatened, whether by pollution, climate change or over-exploitation.
Nature’s gifts are often hard to value in monetary terms. Like clean air, they are often taken for granted, at least until they become scarce. However, economists are developing ways to measure the multi-trillion-dollar worth of many so-called ‘ecosystem services’, from insects pollinating fruit trees in the orchards of California to the leisure, health and spiritual benefits of a hike up a Himalayan valley.

State crime is an indispensable journal for anyone concerned with all forms of official wrongdoing, which should be for all of us’ – Richard Falk (Albert G. Milbank Professor of International Law and Practice Emeritus, Princeton University and Distinguished Honorary Fellow at ISCI)
State Crime is the first peer-reviewed, international journal that seeks to disseminate leading research on the illicit practices of states. The concept of state crime is not confined to legally recognised states but can include any authority that exerts political and military control over a substantial territory (e.g. the FARC). The journals focus is a reflection of the growing awareness within criminology that state criminality is endemic and acts as a significant barrier to security and development. Contributions from a variety of disciplinary and theoretical perspectives are welcomed. Topics covered by the journal include, torture; genocide and other forms of government and politically organised mass killing; war crimes; state-corporate crime; state-organised crime; natural disasters exacerbated by government (in)action; asylum and refugee policy and practice; state terror; political and economic corruption; and resistance to state violence and corruption.

CALL FOR APPLICATIONS (Global Internet Governance)

The Centre for Communication Governance at the National Law University, Delhi

(CCG) invites applications for various research positions in our Global Internet Governance team.

About the Centre

The Centre for Communication Governance (CCG) is the only academic research centre dedicated to working on the information law and policy in India and in a short span of four years has become a leading centre on information policy in Asia. It seeks to embed human rights and good governance within communication policy and protect digital rights in India through rigorous academic research and capacity building.

The Centre routinely works with a range of international academic institutions and policy organizations. These include the Berkman Center at Harvard University, the Programme in Comparative Media Law and Policy at the University of Oxford, the Center for Internet and Society at Stanford University, Hans Bredow Institute at the

University of Hamburg and the Global Network of Interdisciplinary Internet & Society Research Centers. We engage regularly with government institutions and ministries such as the Law Commission of India, Ministry of Communications & IT, Ministry of External Affairs, the Ministry of Law & Justice and the International Telecommunications Union. We work actively to provide the executive and judiciary with useful research in the course of their decision making on issues relating to civil liberties and technology.

About our Global Internet Governance Work

As part of our internet governance work, we track international institutions that make up the complex global regime that governs the internet. We have followed, commented and analysed many important processes such as the the negotiation of theInternational Telecom Regulations (ITRs) at the World Conference on International Telecommunications in 2012, the Working Group on Enhanced Cooperation (WGEC)

(2013-14), the 2014 International Telecommunications Union (ITU) Plenipotentiary

Conference in Busan, the IANA Transition at the International Corporation for Assigned Names and Numbers (ICANN) (2014-16) and the ten year review of the WSIS process at the UN General Assembly in 2015. On some of these issues, we have worked closely with the Ministry of Electronics and Information Technology (MeitY) and supported the work of the Department of Telecommunications (DoT). We are also academic members of the ITU and are looking to expand our work in this area.

We are uniquely placed to carry out research on these issues with a view to embed human rights and good governance principles since we are a law and governance centre within a University. Our recent report, “Multistakeholderism in Action” provides a basis for evidence based discourse on Indian participation at international internet governance institutions. Call for Papers Special Issue on Uniform Civil Code

Article 44 of the Constitution of India provides that; “The state shall endeavour to secure for the citizens a

uniform civil code throughout the territory of India”. In the landmark Shah Bano case, the Supreme

Court regretted that Article 44 of the Constitution of India in relation to bringing of Uniform Civil Code

in India remained a dead letter and held that a common civil code will help the cause of national

integration by removing disparate loyalties to laws which have conflicting ideologies. Recently, the Law

Commission examined the implications of implementing uniform civil code, thereby resurfacing the

debate on whether the constitutional mandate under the Directive Principles of State Policy should be

made a reality. It has been argued that the personal laws should be replaced and a code on marriage,

divorce, succession, custody, adoption and maintenance should be common, governing every citizen.

The JLPP solicits submissions for its fourth issue to be launched in June 2017. Original unpublished

research papers are invited in the area of Uniform Civil Code and any of the following sub themes;

Common civil code/law v/s Uniform civil code; Uniform civil code: from status to contracts; Uniformity

or pluralism; UCC, Constitution of India and Constitutionalism; UCC, Multi culturalism and secularism;

The Jurisprudence on Uniform Civil Code; Uniform Civil Code and conflict of Personal Laws; UCC and

Human Rights; Gender equality and family law; Uniform Civil Code in Comparative International Law;

and any other related themes.

The author/s can make submissions under the following heads:

1. Scholarly articles and research Papers (5000-8000 words, inclusive of

footnotes).

2. Short Articles (3000 -5000 words, inclusive of footnotes).

3. Case Comments, Legislative Briefs, Law Commission report/review and book review (1500-2500

words, inclusive of footnotes).

4. Book Review

The deadline for accepting submissions is March 31st, 2017. Submissions are to be made only in

electronic form. The same may be e-mailed to bhatsairam@nls.ac.in (in MS Word format) along with a

covering letter addressed to Dr.Sairam Bhat (Coordinator & Chief Editor, Journal of Law and Public

Policy,(2017). The covering letter should include the author’s contact information and a short abstract

that outlines the main

or themes addressed in the paper. All submissions will go through an

initial round of review by the editorial board and the selected pieces will subsequently be sent for peer-

review before finalization for publication. We encourage potential contributors to adhere to

a uniform mode of citation throughout the whole work.https://www.nls.ac.in/resources/year2017/JLPPucc2017.pdf
