National Conference on Exploring Critical Perspectives in Criminal Law’,18th – 19th June, 2018, NLU-DELHI.
ABOUT
The operation of criminal law and its institutions is evoking a serious debate
among various sections of the society. The main reason is that there is a general
feeling that the limits of application of the criminal law are getting seriously
compromised which is resulting into the indiscriminate use of criminal law
provisions. There are many instances where the use of criminal law become
coercive. The core idea of use of force of criminal law and balancing of
individual’s fundamental rights is increasingly coming into question. Many kinds
of human acts are increasingly brought into purview of criminal law operation. In other words, criminalization is becoming pervasive. Due process considerations
in criminal law are getting relegated to the background and being dominated by
crime control options. The selective application of criminal law is detrimental to
the future of democracy. The decision to criminalisation or decriminalisation of
several social issues like adultery, suicide, triple talaq, marital rape etc. have
thrown several critical questions requiring a serious debate. The instances of not
following the crime registration process, penchant for arrest, unfair investigation,
denial of bail, withdrawal from prosecution, reliance on custodial options by law
enforcement agencies are some of the coercive and critical developments in
criminal law to be sifted concertedly.
This conference attempts to explore the broad range of critical perspectives in
criminal law and actors involved in the criminal justice system.
THEMES
In view of the above following core theme are to be debating in the conference:
1. Emergence of critical perspectives in criminal law
2. Critique of normative and institutional perspectives in criminal law

wrongfulness of the process

ILNU hosted a Panel Discussion on Baptism by Fire : Trial of Speech, Democracy and Media in India”.
Institute of Law, Nirma University organized a panel discussion presided by Dr. Rafael Cohen Almagor, (Director MESG, School of Politics, University of Hull and Professor and Chair in Politics, School of Politics, Philosophy and International Studies, University of Hull, U.K.), renowned academician Mr. Salil Tripathi (Contributor Editor, Mint and Caravan-Chair, PEN International’s Writers in Prison Committee and Senior Advisor, Institute for Human Rights and Business, U.K.) and senior journalist Mr. Ajay Umat (Senior Editor, Times of India). The Director, Institute of Law, Prof. (Dr.) Purvi Pokhariyal gave the inaugural address where she emphasized on the significance of social engineering and how law students can act as a catapult for the change in society.
Prof. Rafael spoke about the free speech being an intrinsic principle of democracy and shared some examples of how autonomy of press helps in promoting tolerance, protecting human rights and give the marginalized an opportunity of being heard. According to him the litmus test of any democratic nation is the state of its minorities. He emphasized on the evolution of press in United Kingdom and how media mogul Rupert Murdoch played an important role in it. He ended with an observation about media which was “When you control the media, you can control the masses”.
Mr. Salil Tripathi presented his views on hate speech and freedom of expression in Indian politics and how it affects the democratic ethos of the country. He spoke about the mob censorship and various legal provisions which provide a threat to freedom of speech and expression like sedition, blasphemy etc. He also said that there is a need to draw a line between hate speech and dangerous speech which is far more detrimental to democracy. Dangerous speech according to him is which incites violence, has an influential speaker and has audience, asserts or attacks vulnerable groups and is preceded by a historical context.
Mr. Ajay Umat largely focused on Media Spinning, where news are insisted according to the whims and fancies of croni-capitalists. He reiteritated that Media in India can easily be influenced by the powerful and the rich, which is dangerous for the democracy, where freedom of speech and expression are regarded as fundamental rights.

HEURISTIC LEARNING: IS IT THE BEST WAY??
“The only source of knowledge is experience.”
-Albert Einstein
We as humans have evolved from being in the stone-age to the present technologically superior era, all of this evolution has been augmented by education that seeks to inculcate the very essence of the human spirit among the harbingers of our population, the energetic youth, apparently this blatantly obvious fundamental premise has been forgotten by the maven few of the time. Education nowadays is a mechanized process involving the mainstreaming of the nascent brain, to not think beyond certain pre-prescribed limits, obviously one prudent enough can always question the credibility of the officials who decide and give in to such caprice, many show defiance and dare to think that this chicanery is a ploy to make us abide by the governmental directives, to limit ourselves- much like the Marxian concept of limiting the abilities of the Have-nots. This unbelievably obdurate system, unfortunately, is still in vogue as some perceive it to be sacrosanct and of the highest degree of efficacy, quite mistakenly so, is at present unnerving at the least. Time has come for the system which forms the very basis of evolution, be evolved, ameliorated to match the need of the time. Such phrases although might seem to be minatory for the system itself, as a metaphor can be classified to be in the purview of social cause. In the light of recent development in the understanding of the modus operandi of the human brain many scholastic personalities in our society gradually seem to turn towards the more practically beneficial and effective way of learning, heuristics. Even the great Albert Einstein was an advocate of heuristic learning, according to many the method of heuristic learning can be applied to a volley of disciplines, especially in pursuance of professional courses.
“…to learn from life itself and to make the conditions of life such that all will learn in the process of living.”
– John Dewey.
Life experience learning requires one to learn lifelong it is a long and tedious process; they go cahoots with each other. In this kind of experience knowledge is driven by the resolution of dual dialectics of action and experience. Life experience learning since its conceptualization in the 1970 has become a necessary reality from an aspiration, the socio-economic-political changes have been of such magnanimity that the time to rethink the fundamental relation between education and learning, From a system-driven educational structure which is largely dominated by classroom learning, we are moving on to a new reality where individual learners are exposed to a multitude of learning environments that span their lifetime, lifelong learning is not just about learning new skills it is about the whole person and their personal development in their many roles as family member, citizen, and worker.
“Self organized learning certainly has a place in this scenario. But also essential are the twin values of freedom and participation as embodied, for instance, in Dewey’s pragmatism, where learning rests on a mode of life where reason is exercised through problem-solving where the individual participates and contributes to the collective good of society and in the process constitutes their own development.”
– Olssen
This journey of lifelong learning is to inculcate in an individual the processes encompassing the pivotal issue- how to learn, in this regard, one, Experiential learning theory provides a roadmap by helping learners understand how learning occurs and the nature of the spaces where learning occurs this experience is certainly not the easiest but undoubtedly the wisest, it is all about approaching life with a learning attitude enjoying the process of learning more than the end that you are after, it requires an individual to derive knowledge out of meager experiences in life opening oneself to a broader, deeper horizon of heuristics as learning becomes intrinsically empowering and rewarding. Life learning experiences are holistic in nature being the culmination of how one thinks, feels, perceives and behaves these transactions, if they may be termed such; arise mostly out of the synergic interaction between man and environment. There are a few ways in which such experiences enrich an individual- Concrete Experience and Abstract Conceptualization and two dialectically related modes of transforming experience Reflective Observation and Active Experimentation. Experiential learning in toto is a methodical construction of knowledge that involves a creative fabrication of the four learning modes this recursive process is sensitive to learning situation and what is being learned hence has been proved to be the of the highest degree of efficacy. Much like the older times when the concept of ‘gurukul’ was prevalent, the students there were exposed to certain learning spaces or situations and then abiding by the fundamental ‘dharma’ that the ‘guru’ had preached the students used to absorb knowledge form those pre fabricated situations. These theoretical jargons can be simplified by a very simple yet copious example- A trained Surgeon is trained!, to dissect and make a precise cut they undergo a process of extensive training before they try it on a person…so one can ask why are these training sessions essential?? A simple answer would be- so that the person doesn’t die because of the surgeon’s mistakes but from another perspective we can comprehend that this very training is to ensure accuracy, that which is begotten by practice, experience in a learning environment, in a learning space, hence, Heuristically.
The modern education impartation techniques being used for a long time, which involve mainstreaming of young minds is now gradually being done away with, outside India, however the educational structure in India is still debilitating, nothing being done to mitigate the problem, with the maximum number of suicides among the students regarding some reason, reasonably, relatable to academics, we can only hope that the government officials responsible for the relevant changes can see the blatantly obvious benefits through banal attempts, such as these, ensuring heuristic learning to be established in situ as the primary and most effective mode of dissemination of knowledge.
