Moot Court Competition at Auro University, Surat, Gujarat on 28th,29th February & 1st March2020:

The Moot Court Committee namely, AURO Litigiosus Committee (ALC) of School of Law, AURO University, Surat is proud to present to you the 6th AURO National Moot Court Competition, 2020 to be held on 28th, 29th February and 1st March 2020.

VENUE: AURO University, Surat, Gujarat.

About the Moot Problem:

This year the problem is related to the practicalities of Autonomous Vehicles. The spurt in the growth of technology has made communication both more convenient as well as complex. We, therefore invite law students from across the country to engage in the first ever moot competition on the topic of ‘Regulation of Autonomous Vehicles’. The intersection of law and technology has constantly engaged academicians, experts and practitioners in the legal industry and the ramifications arising out of disruptive technologies are increasing drastically along with the burden of legal institutions, particularly when they are entrusted with the responsibility to ensure justice. Off late, technology has taken the form of Autonomous Vehicles to challenge the current state of legislations across jurisdictions, posing humongous socio-economic and legal implications including that of inter alia liability, ethics, human autonomy and privacy.

Although, India is yet to encounter this disruptive technology, the R&D in advanced economies has long begun and is proliferating exponentially every day. Given this, it doesn’t seem far-fetched to imagine an extensive use of such vehicles on the Indian streets in the coming years. In order to address the complexities arising out of this revolution of technologies in the absence of any domestic legislation catering to such a critical futuristic issue, School of Law, AURO University is organizing the 6th edition of AURO National Moot Court Competition scheduled from 28th of February, 2020 to 1st of March, 2020 with the aim of fostering quality research, debate and suggest appropriate reforms to the subject matter.

RTI Query Reveals That You Can Carry Your Own Food To Movie Halls & No One Can Stop You:

RTI Query Reveals That You Can Carry Your Own Food To Movie Halls & No One Can Stop You:

One of the biggest banes of going to watch a movie in a theatre is the cost of food that drives a hole through your pocket. For as long as we can remember, cinema-goers have been barred from carrying food and water into the premises of the hall.

However, that scenario seems to have changed in Hyderabad. In response to an RTI query, the Hyderabad police recently announced that patrons will be allowed to carry their own food and water into a theatre.

The multiplexes cannot restrict the audience from carrying their food. Hyderabad based anti-corruption activist, Vijay Gopal, filed a query for which Hyderabad City Police responded.

Under the Cinema Regulation Act of 1955, there are no restrictions for patrons regarding food. “This rule has been there for many years but the theatre lobby almost banished it. Hence, such rules are good only on paper since the greedy exhibitors in the two Telugu states, will not allow patrons to carry food items in near future,” says distributor Venkateswar Rao, who says that four to five lessees are making more than 100 to 300% profits on foods and beverages.

In their reply to the RTI, Hyderabad police said that there exists no law in the Indian constitution, which can stop a movie-goer from carrying their own food inside a movie hall.

In 2017, Vijay Gopal had filed a complaint with the Hyderabad Consumer Forum regarding the same and INOX multiplex was ordered to pay up Rs 5,000. Also, an additional amount of Rs 1,000 was directed to be paid, as Vijay was charged extra for water bottles. On this, INOX  was also asked to discontinue the unfair trade practices.

Hyderabad police have said that any citizen can file a complaint with the Legal Metrology Department, in case they feel a particular business is breaking the law.

The response also suggests that no single-screen theatre can charge a customer for providing 3D glasses. Plus, they should not stop a customer from carrying his/her own 3D glasses to a theatre if they do not wish to pay for it.

Maharashtra Government had recently allowed outside food to be carried inside cinema halls; there is a toll-free number where you can complain if you face an issue.

FYI a similar  PIL was filed by Jainendra Baxi who is associated with the entertainment, through lawyer Aditya Pratap in 2017, claiming that there was no legal provision prohibiting one from carrying a water bottle and food items inside movie theatres.

In our hectic lifestyle, going to the cinema is one way to bust stress. However, with the exorbitant rates of tickets and of course has discouraged many from keeping it as an option.

Agreed, food and beverage is one of the three revenue streams for a multiplex, the other two being box office collections and advertising. But if Hyderabad has forgone this ‘luxury’, isn’t it time for theatres across the country to do same?

NATIONAL SEMINAR ON ‘’Centre State Relations Under Indian Constitution”28th MARCH 2020 (Saturday):

NATIONAL SEMINAR ON ‘’Centre State Relations Under Indian Constitution”28th MARCH 2020 (Saturday):

About the Seminar:

India adopted a Federal Constitution where the powers have been divided into the Centre Government and the State Governments. Both Units are entitled to perform their functions within their assigned area and cannot go out of it or encroach on the area assigned to the other. However the Federal framework of the Indian Constitution provides for a good deal of centralization. The Union Government has a large sphere of action and plays a more dominant role than the States. There is a long Concurrent List containing subjects of common interest to both the Centre and States in which both Centre and State Governments can legislate and in case of conflict the Centre is to dominate. The Emergency provisions provide a way of transforming the normal Federal fabric into an almost unitary system, so as to meet national exigencies effectively. In certain circumstances the Parliament becomes competent to legislate even in the exclusive field of the State. The process of amending the Constitution for that matter is not very rigid. The Constitution of India is a single frame which applies to Centre as well as States and no Unit can get out of it but has to work within this framework. No State Government can frame its own Constitution and every Unit is to be governed by the provision of Constitution of India.

Research Papers and Sub-Themes:

  • Nature and History of Federalism in India
  • Reasons for making the Central Government strong as compared to States in India
  • Distribution of Legislative Powers in India
  • Distribution of Administrative Powers in India
  • Distribution of Financial Powers in India
  • Power of Union to deal with Extraordinary provisions such as Emergency
  • Provisions in case of failure of Constitutional machinery in State
  • Power of Parliament to legislate with respect the Matters in the State list
  • Power of Parliament for formation of new States and Alteration of Areas/Boundaries and Names of the States as well as Extinct the existing State

National Seminar on Empowerment of Tribal Women in India: Issues, Challenges and Perspectives 7th-8th March, 2020:

National Seminar on Empowerment of Tribal Women in India: Issues, Challenges and Perspectives 7th-8th March, 2020:

About the Host University:

The National Law Institute University, Bhopal (NLIU), was established by the Rashtriya Vidhi  Sansthan Vishwavidyalaya Adhiniyam, by an Act No. 41 of 1997 enacted by the Madhya Pradesh State Legislature and recently substituted by MPNLIU Act, 2018. NLIU is recognized by the University Grants Commission and the Bar Council of India. The vision of NLIU is to become one of the best centers of legal education, training and research in the world. Its mission is to develop and nurture the intellect for the betterment of the nation and humanity through law and justice. The University seeks to contribute to the national development by instilling a sense of responsibility among her students, while simultaneously cultivating in them the spirit of intellectual freedom, leadership quality and professional ethics.

About the Seminar Tribals in India are known for their unique cultural identities and diversified cultural mosaic in terms of language, dress, mores, folkways, customs, economy, polity, and ethnic-religious practices, etc. The population of tribals in the country is 10.45 million constituting 8.6 per cent of the total population as per census 2011, 47.9 per cent of which are women. While numerous measures were adopted by the policy makers, tribal India, in general and tribal women in particular continue to languish. Despite being active contributors to tribal economy, women in tribal society are placed at the lowest rungs of the socio-economic and political development. The non-recognition of the customary laws, discrimination and exclusion of their cultural ethos & eidos, and the deliberate attempt to implement the policies and programmes without taking into account the tribals needs and sentiments has threatened tribal culture and lifestyle. The National Law Institute University, Bhopal (M.P.) aims to organize a two-day National Seminar to discuss and deliberate the issues and perspectives related to the mainstreaming of tribal women in India on the following themes:

1.Customary Laws and Tribal Women

2.Gender injustice and Human Rights of Tribal Women

3.Tribal Women and Forest based Economy

4.Panchayat Raj Institutions and Tribal Women

5.Education, Health and Malnutrition in Tribal India

6.Multiculturalism and Tribal Women

In addition to the above main themes of the seminar, the participants are free to present papers on any other theme related to the issues and challenges of tribal women in India. Papers are invited from academicians, researchers, NGO representatives, government functionaries, research institutes and others working for the mainstreaming of tribal women in India. Selected papers will be published after due consultation with National Commission for Women, New Delhi.
