About the competition

Cyberspace is an intangible dimension with lawlessness and the absence of respect for jurisdiction. Digitization is an important facet to human life in imparting valuable information, economic gains, keeping connected and so many others but the limitations attached to it cannot be overlooked. Henceforth, protecting the cyberspace from belligerent cybercrimes is perceived to be more challenging than ever as people are facing a pandemic of its own. Thus the premise of this debate is to give a platform to people for encapsulating and analyzing the challenges and wonders of this digital era we all live in. This debate will accelerate participant’s familiarization with contemporary issues of law which provides new and exciting ways of exploring the changing dynamics of our world regime, in order to compete and deliberate upon proposing for safer cyberspace.

Topic – Astounding effects of digital era echoes for an unprecedented cyber pandemic

Eligibility – This competition is open for the present bonafide students of law studying in a 3-year LLB program or 5-year BA.LLB program in India or abroad.

Rules and guidelines-

  • The debate will be conducted on 5th August 2020 via virtual platform.
  • Two participants can participate from each university and one can participate individually as well. Uploading a copy of the college id is mandatory in the registration form.
  • The participants will be allotted team codes and shall only represent themselves by their respective team codes. They are not allowed to disclose their identity.
  • There will be 3 rounds:
  1. Preliminary Round – 20 teams
  2. Semi-final Round – 10 teams
  3. 3rd – Final Round – 4 teams
  • Each speaker will be allotted 3 minutes for 1st round and 5 minutes for the 2nd and 3rd round for their respective stand. Also, there will be an open ground for rebuttal and interjections in semi-final round.

More than 2000 women Lawyers from across the country petition to the Hon’ble Home Minister to come to the aid of financially drained Advocates community due to Corona Pandemic and also to improve infrastructural facilities of the virtual courts.

It is for the first time in the history of our country that women advocates have stood up for the cause of the entire Advocates community.

Deeply affected and saddened by the financial stress that the lawyer’s community is facing since March this year due to the restricted ( near closure) functioning of courts, the women advocates decided to speak out for the entire legal fraternity to seek help in the form of loan on reasonable terms and conditions .

They started a signature drive on 21st of July 2020 and in a short spell of 40 hours or so, the number of responses on the representation crossed 2000. The data collected reveals that women advocates from the entire length and breadth of Bharat, i.e from Jammu & Kashmir to Kerala and Meghalaya to Rajasthan, with approximately around 400 districts from 28 States and 8 Union Territories have stood up for the collective call and cause of all the advocates. The signatories of the representation were moved by the plight of several of their colleagues committing suicides or taking up odd jobs during this time.

In the said representation the lady lawyers requested Hon’ble Home Minister to take steps to provide financial assistance to the Advocates under the Disaster Management Act, 2015 on reasonable terms and conditions and also to improve infrastructural facilities of the virtual courts. A copy of the said representation has also been sent to the Prime Minister’s Office, Hon’ble Law Minister and Hon’ble Finance Minister.

The Hon’ble Supreme Court has already taken up this issue and asked the Bar Council of India to respond. Several concerned Senior persons and organizations including the Akhil Bharatiya Adhivakata Parishad have already represented to the Finance Ministry on this issue.

It is known to all that even during the current process of ‘unlocking’, the courts are still functioning on nominal basis only and it is the virtual courts which have become the order of the day. Most of the Advocates do not have proper infrastructure and electronic gadgets such as laptops, scanners, good wi-fi for better bandwidth and even dedicated spaces in the Associations to participate in virtual hearings in virtual courts effectively. It is for this reason they are not able to assist in the justice delivery system effectively. If the representation moved by the women advocates is considered by the Ministry, then it will be of immense help to the entire advocates community in overcoming the financial hardships encountered during the current National Health Emergency and will also improve the functioning of virtual courts.

4 LANDMARK JUDGEMENTS ON THE LAW OF TORTS

BHIM SINGH V STATE OF J & K AND Ors, 22ND NOVEMBER, 1985, AIR 1986 SC 494, (1985) 4 SCC 677

  • FACTS: Bhim Singh was a member of the Legislative Assembly of Jammu and Kashmir. He was suspended from attending the assembly on the opening day of the Budget session, whose order of suspension stayed in the High Court till 9th September, 1985. He was on his way to Srinagar from Jammu, he was taken away by the police near a place called Qazi Kund at 3 am in the night. His wife, Jayamala asked the respondents to produce Bhim before the Court as he was unlawfully detained by the police officers. He was not produced before the Magistrate for four days and was kept in a police lock-up. There was no doctor to see him as well. He was finally produced before a Magistrate on the 14th. He filed an affidavit regarding this and his illegal detention.
  • There were counter affidavits also from the side of the police who stated that Bhim was involved in a case of inflammatory speech in the Parade Ground and therefore he was taken by the police. They had even produced a medical certificate in his case.
  • The police could not explain how they knew he would pass from Qazi Kund at that night or how he was to be escorted by the Senior Superintendent of Udhampur and his officers. Therefore, the Court came to a conclusion that since there was a meeting on the 11th, it was expected of him to pass on 10th from that area and they arrested him to prevent him from attending the session of the Legislative Assembly. Police Officers have a duty of care towards the citizens and such bizarre acts of lawlessness are not expected of them.
  • JUDGMENT: Therefore, the Court ordered that since he was no longer detained, there was no point of liberty. But, since his legal rights were violated by the custodians of law, he was entitled for a monetary compensation. So, the State of Jammu and Kashmir was ordered to give a sum of rupees 50,000 to the Registrar of the Court who would give it to Bhim Singh as a monetary compensation for his illegal detention.

DONOGHUE V STEVENSON 1932 S.C. (H.L.) 31, 1932 S.L.T 317, [1932] W.N. 139:

  • FACTS: In this case, a friend of Donoghue bought her a ginger beer from a café which she half drank. When she poured the remaining half in a tumbler, she could see remains of a snail in it which was not visible before as it was an opaque dark bottle. She was extremely shock and it caused her severe gastroenteritis after that. Therefore, she took her case to the House of Lords.
  • The main question in this case was that whether there was any contractual relationship between Donoghue and the manufacturer or did the manufacturer have any duty of care towards Donoghue.
  • That time the question of negligence only came into picture when there was a contractual relationship.
  • JUDGMENT: This judgment was given by a 3-2 majority by Lord Atkin in the House of Lords. It was held that the concept of negligence was different and separate in the Law of Torts. It was even held that there was no requirement for any contractual relationship to owe a duty of care to anybody. The manufacturer of any good, by default, owes a duty of care towards the consumer who uses his product. Therefore, in this case as well, the manufacturer of the ginger beer had a duty of care towards the consumer who consumed his product, like in this case, Donoghue and therefore he was liable for negligence in his part.

THE GLOUCESTER GRAMMAR SCHOOL CASE, (1410) YB 11 HEN IV:

  • FACTS: In this case, a dispute arose between the School and one of their teachers who is the defendant. Therefore, the defendant opened a rival school next to the school of the plaintiff. This caused a lot of monetary loss to the school of the plaintiff. Therefore, he filed a suit against the defendant for infringing his legal rights.
  • JUDGMENT: The Court observed that it is a case of Damnum Sine Injuria. In this case, there was only damages caused to the plaintiff by the actions of the defendant but his legal rights were not infringed. There can be damages awarded to the victim only in case of Injuria Sine Damnum which is when the legal rights of a person is infringed. It was not a case of Injuria Sine Damnum and therefore no damages were awarded to the plaintiff and his suit was dismissed.

PADMAVATI V DUGGANAIKA 1975 ACJ 222:

  • FACTS: The driver of the car who is one of the defendants in this case was taking his car to the petrol pump. On the way, two strangers took lift in his car. Suddenly, one of the bolts to the right wheel which fixed it to the axle gave way and therefore the jeep toppled. This led to serious injuries of the strangers and one of them even succumbed to the injuries. The plaintiff, who was the stranger who took the lift filed a case against the driver driving the vehicle and the owner of the vehicle who was his master for damages sustained in that accident.
  • JUDGEMENT: The Court stated that it was a case of Volenti Non Fit Injuria which means that if a person voluntarily, without any pressure on him does some act in which he knows there could be some danger, he has voluntarily agreed to bear the danger in case it happens. In such cases, the master or the servant cannot be held liable for any damages caused to the person because of any danger that he had voluntarily signed up for. Similarly, in this case, the strangers voluntarily took lift in the car knowing that there could be chances of accidents. So , in such a case, the driver driving the vehicle or his master cannot be held liable for anything that happens to the victim within the radius of foreseeable danger and in this case accident was definitely a foreseeable danger. So, the suit of the plaintiff was dismissed and the master or the servant was not held liable.

World Forum for democracy 2020: Call for initiatives

Our societies have been tested by unexpected global challenges in 2020, but all the while humanity’s greatest existential threat looms ever larger. Environmental damage and climate change have not gone away.

They are still poisoning our air, polluting our water, and killing animals and humans alike. Rising temperatures and sea levels are on course to render lands uninhabitable and force people from around the world to leave their homes and rebuild their lives. The time to act is now. Yet recent polling indicates the highest ever recorded levels of dissatisfaction and mistrust with democracy as a system of government.  Its response to a whole series of recent challenges – economic, pandemic, and indeed environmental – have disappointed millions of people. Many are questioning the capacity, competence and even legitimacy of democratic governance to address their greatest needs. The ambition of the 9th World Forum for Democracy is to propose and discuss differing answers to the question of what it really takes to get the job done when it comes to stopping and reversing the devastating damage done to our environment.

The World Forum for Democracy calls for expression of interests in presenting innovative initiatives aiming at solving environmental problems and enhancing democracy from all over the world.

Manuscripts will be considered as they are received Martha Fineman’s vulnerability theory is premised on an understanding of the human condition as one of universal and constant vulnerability. As human beings, our embodied state leaves us susceptible to
continuous change in our well-being and our embeddedness in social institutions and arrangements and the nature and operation of those institutions enable us, to varying degrees, to build and exercise resilience. Fineman’s notion of the universal body, ‘understood as prior to the social or political, as independent of existing or imagined ethical, or moral social arrangements’1 provides a useful starting point for thinking about the effects of and responses to the Covid-19 pandemic across different states and
within different legal contexts.

The editors of this special issue are interested in submissions which interrogate how states have historically organised their social welfare responses to vulnerability and how those social arrangements have mitigated or exacerbated the effects of the pandemic. Such insights may provide commentaries on how governmental responses should be devised and supported using the lessons learned. Rather than framing these interrogations and responses by way of a traditional non-discrimination approach which distinguishes between individuals and groups on the grounds of their perceived specific vulnerabilities, analyses should start from the perspective of our shared universal vulnerability as embodied beings. In this way we seek to explore how the corporeal manifestations of the pandemic are reflected, deflected and reproduced in and by the state in its various guises and within different contexts by way of pre-existing institutions, relationships and the arrangements that flow from them and to identify the route out of this that a vulnerability perspective offers.

Contributions are welcome which explore experiences of the pandemic within a single state, geographical region or through a comparative approach and which consider the impact of the pandemic on one area of law and/or policy (for example, family law, social security law, medical law, economic law, employment law, etc.) or across legal and policy frameworks more generally.

Relevant questions for consideration include:
 How has the state’s historical conceptions of vulnerability impacted on its responses to the current pandemic?
 Has the focus on ‘particularised bodies’ limited state responses to Covid-19?
 What has the pandemic revealed about the current construction of social relationships and institutions and how might a vulnerability approach be used in response?

 What do state responses to Covid-19 tell us about the current construction of the human body
in legal and policy frameworks?
 What does the pandemic tell us about the role of legal subjectivity in constructing the
relationships and institutions that order society for everyone?
 What has the pandemic exposed regarding who bears the burdens for the social reproduction of
society and its institutions and how might this be impacted in future?
 What might the crisis mean for reimagining the ‘responsive state’?

Trivent publishing has debuted a new book series on criminal justice and philosophy, edited by Blake Wilson. The editors welcome submissions on a wide range of themes, from the moral problems of incarceration to historical perspectives on crime and punishment.  A fuller description is available on the publisher’s website.

ABOUT THE SERIES

This series aims to canvas innovative, critical, and global/international debates addressing the intersection of criminal justice and philosophy (social, political, ethical, and legal). ‘Criminal Justice’ is broadly understood to include formal institutional responses to crime and misconduct, as well as informal and non-institutional responses which include behaviors considered ‘deviant,’ anti-social,’ or otherwise outside the scope of criminal law.

We invite proposals based on empirical research, conceptual analysis, and theoretical work for monographs, handbooks, or edited collections on a broad range of topics. Proposals can include topics related to the philosophy of criminal justice as well as criminal justice and philosophy. We are particularly interested in the exploration of innovative approaches to the problems presented by the classification of certain behaviors as criminal or ‘merely’ wrongful, the maintenance of separate criminal and civil legal institutions, and the pervasive use of coercive institutions (police, jails, prison) as mechanisms of social control and punishment.

The editors are particularly interested in proposals across the following thematic areas:

– The role of political agents in criminal law and procedure: popular, legislative, executive
– Geographies of crime, violence and justice in terms of race, ethnicity, class, and nationality (e.g. differential punishment, mass incarceration, etc.)
– Crime prevention and social/cultural change

– Alternatives to punishment: restorative justice, compensatory justice, etc.
– The abolition of the prison

  6. Decisions of the organizing committee will be final.

The European Competition and Regulatory Law Review (CoRe) reports on key legislative developments in the EU and its Member States, and analyses important judgments that shape the field of EU competition and regulatory law, in particular those by the European Courts, international courts and tribunals, and higher national courts.

Topics covered by the journal include:

Concept Note

The outbreak of Covid- 19 has created an unprecedented situation all over the world. Each state is trying to overcome this pandemic’s challenges and adopting various methods to curb the spread of the virus through various methods such as regular thermal screening, sanitising places, imposing lockdowns to name a few. While using all these methods states are obliged to abide by the various principles of International law. Due to the state-centric nature of the International legal framework on laws of responsibility and states being entities which are capable of bearing rights and duties, it is easy to create obligations binding on states during this crisis in case it fails to meet the requirements mandated by international law principles. However, difficulties arise when applying the law of responsibility to armed non-state actors (ANSAs) in conflicts affected areas. With the passage of time, International law did evolve to cover various actors and international entities within its subject matter, But the development of the legal framework to regulate the responsibility and accountability for the wrongful conduct of armed non-state actors is still inadequate as compared to that of a state.

This webinar conceptualizes how International law can respond to Covid- 19 pandemic in conflicts affected areas controlled by non-state actors. It will also analyze the legal obligation of armed non-state actors in International law. In the end, the session will highlight key challenges and the possible way forward in this area.

 

About the Speaker

Dr. Anita Yadav is currently working as an Assistant Professor of Law at Campus Law Centre, University of Delhi.

She is a recipient of various International and national fellowships. In 2018 she has received United Nations Asia & Pacific Regional course International Law fellowship. She is also the recipient of Erasmus Mundus research scholarship at Georg-August University of Goettingen, Germany (2015-2016).

About The Book

Electronic waste or E- waste describes as the discarded electrical or electronic devices. The used electronics which are destined for refurbishment, reuse, recovery, salvage recycling through material recovery, or disposal are also considered e-waste. Most electronic waste goes through a recycling system called a WEEE (waste Electronic and Electronic Equipment), which not only recycles 95-98% by weight, of all e-waste passed through it, but ensues that any date left on hard drives and memories are thoroughly destroyed too.

E-waste management is a great challenge for governments of many developing countries such as India. This is becoming a huge public health issue and is exponentially increasing by the day. In order to separately collect, effectively treat, and dispose of e-waste, as well as divert it from conventional landfills and open burning, it is essential to integrate the informal sector with the formal sector.
