We are a team of three free journals dealing with Crime and Criminology; Intellectual Property Rights; and Law and Humanities. Whereas DROIT PENALE: (ILJCC) is an already established journal and has organised the 1stNATIONAL SYMPOSIUM, but through this 2ndNATIONAL SYMPOSIUM we are obliged to introduce INTELLECTUAL PROPERTY RIGHTS and LAW AND HUMANITIES in the arena.

We organize seminars, symposiums, awards, and free legal aid camps from time to time for the welfare of the society.

Eminent personalities from various spheres of legal profession will be attending the seminar.

INVITATION FOR INSOLVENCY AND BANKRUPTCY MOOT COMPETITION 2018

 

The National Law University, Delhi, supported by the Insolvency and Bankruptcy Board of India (IBBI), and the UNCITRAL RCAP, in collaboration with INSOL India and Society of Insolvency Practitioners of India (SIPI) have initiated a moot competition on insolvency and bankruptcy. The Moot is organized by the Centre for Transnational Commercial Law (CTCL). The inaugural edition of the competition was held on 28-29 October 2017 at the National Law University, Delhi, India.

Insolvency is a sophisticated and complex economic law.  It is one of the most critical components of the financial architecture of any country involving a wide range of stakeholders. It is critical that the students of law, commerce and management understand the nuances of this specialised subject by both, education and training in this field. This will enable them to choose a career out of many streams of profession this branch of commercial law offers and prepare them for industry engagement.

The format of the Competition is based on the process envisaged under the IBC. For the purpose of this moot, it will be assumed that India has adopted the UNCITRAL Model Law on Cross-Border Insolvency 1997.

The 2nd edition of this Competition shall have teams from law universities and schools of management and economics. Selection of teams will be based on written memorandums and only shortlisted teams would proceed for oral rounds.

The theme of 2018 edition is Process Memorandum and Resolution Plan. The participating teams will prepare and submit a Resolution Plan as Resolution Applicant based on information memorandum and other relevant information supplied to them. Teams will be shortlisted based upon the quality of submission. Shortlisted teams will participate in the oral rounds. In the oral rounds, teams will present the Resolution Plan and make arguments on its merits to industry experts acting as judges.

The competition flyer is attached. The moot problem and the Rules of the Competition will be released on 30.06.2018 . It would also be available on the NLU, INSOL India, SIPI and IBBI websites.

National Law University, Delhi would be glad to host (accommodation and hospitality) the shortlisted teams as our guests during the course of the Competition.

 The Centre for Environmental Legal Studies (CELS), a research centre on Environmental Legal Studies at the Rajiv Gandhi National University of Law, Punjab invites professionals, faculty members, researchers and students of law to contribute research articles to be considered for publication in a proposed edited book, to be published under the aegis of the University. Any original scholarly work providing multi-disciplinary discussions on the environment and following the general theme outlined hereunder shall be considered for publication as part of the Book by the Editorial Board. The articles submitted would be peer- reviewed by select expert panel.

About

Much has remained unaccomplished since the sublime understandings of Stockholm and Rio, creating a desperate need for immediate action in ways which can not only meet present goals, but also compensate for the time lost. Technology is bound to play a great role in the achievement of this purpose, poetically atoning for its own doings, but the same must first side-step hindrances of tradition corporate ideologies and legal barriers imposing personal monopolies over intellectual properties. This requires a dynamic and motivated legal system, which is decidedly dedicated to meeting the continually emerging challenges in the path of a better world free from human indignity, impoverishment and environmental enervation.

The proposed book, through its contentious theme based topics, will attempt to build on the above needs and explore the complex and unique interplay between the environmental laws and economics, technology, intellectual property rights, commerce, human rights, and international relations, aiming to establish dialogue and forward solutions on major environmental law challenges from a national as well as an international perspective.

Submission Guidelines

General Instructions

  1. All manuscripts should be original and should not be published elsewhere or be simultaneously considered for publication elsewhere till the final decision of the Editorial Board as to the manuscript is made.
  2. Submissions must consist of the abstract, manuscript and a declaration of originality.
  3. The abstract must be submitted as a separate word document. It should not contain more than 600 words, but should nevertheless provide insight into the main theme and a gist of the ideas explored in the article.
  4. The manuscript will be considered with regard to originality of ideas, quality of analysis, and quality of expression. Plagiarism will lead to immediate disqualification of the manuscript from the review process.
  5. After initial screening, short-listed submissions will go through peer review process and the final selection will be based on the recommendations of the peer reviewers.
  6. Maximum of two authors can collaborate for any submission.
  7. The last date for submission is 15 July 2018, 11:59PM.

 

Categories of Writings

Only Research Articles will be considered for publication with a word range of 3000-8,000 words (excluding footnotes). Some flexibility with the word limits may be granted by the Editorial Board on a case-to-case basis.

 

Format

  1. Font Type and Size of the main text must be Times New Roman, 12.
  2. Font Type and Size of footnotes must be Times New Roman, 10.
  3. Line Spacing of the main text and footnotes must be 1.5 and 1 respectively.
  4. Use of headings and Sub-Headings is encouraged.
  5. Citations must be conform to Bluebook 19thEdition format as far as practicable.

  1. The submissions are to be made through attachment of the manuscript and the abstract in .doc or .docx format only.
  2. The email must have the subject as- “Submissions for RGNUL Edited Book-[Name of Author]”.
  3. The submission should also include a word file containing the details of the author, including- name, contact number, email, designation, and affiliation.

This scholarship programme offers you the opportunity to continue your academic education in Germany with a postgraduate course of study.

Who can apply?

  • Excellently-qualified graduates who have completed a first degree (Bachelor, Diplom or comparable academic degree) at the latest by the time they commence their scholarship-supported study programme.
  • For applicants from artistic disciplines and the field of architecture, the DAAD offers subject-specific scholarship programmes.

What can be funded?

  • Participation in a postgraduate programme after a first undergraduate course of study for the purpose of technical or scientific specialisation
  • Specifically, the following is supported:
    a postgraduate or Master’s degree programme completed at a state or state-recognised university in Germany
    or
    the first or second year of study at a state or state-recognised German university as part of a postgraduate or Master’s degree programme completed in the home country or in another foreign country; recognition of the academic achievements rendered in Germany must be guaranteed. The standard period of study of the postgraduate or Master’s degree programme should not be exceeded as a result of the study year in Germany.

Duration of the funding

For a postgraduate or Master’s degree completed in Germany:

  • between 10 and 24 months depending on the length of the chosen study programme
  • The scholarships are awarded for the duration of the standard period of study for the chosen study programme (up to a maximum of 24 months). To receive further funding after the first year of study for 2-year courses, proof of academic achievements thus far should indicate that the study programme can be successfully completed within the standard period of study.
  • Applicants who are already in Germany in the first academic year of a 2-year postgraduate or Master’s programme at the time of their application may apply for a scholarship for the second year of study. In this case, it is not possible to extend the scholarship.

For a study period in Germany as part of a postgraduate or Master’s degree completed in a foreign country:

  • usually one academic year; an extension is not possible.
  • The scholarship usually begins on 1st October, or earlier if the student takes a language course prior to the study programme.

Value

  • Scholarship payments of 750 euros a month
  • Payments towards health, accident and personal liability insurance cover
  • Travel allowance, unless these expenses are covered by the home country or another source of funding
  • One-off study allowance

Under certain circumstances, scholarship holders may receive the following additional benefits:

  • Contribution towards tuition fees that may be charged by the university (max. € 500.- per semester)
  • Monthly rent subsidy
  • Monthly allowance for accompanying members of family

Language skills

  • When you apply for your chosen study programme, you are usually required to prove that you have an adequate knowledge of the language of instruction. You can find out exactly what language skills are required in the university’s study and admissions regulations.
  • Good German language skills – especially for students taking arts subjects – are usually a requirement for studying in Germany. Exceptions are possible if scholarship holders are participating in programme which is taught in English.

Application Procedure:

The application procedure occurs online through the DAAD portal. You are also required to send 2 copy/copies of the “Application summary” (PDF file), which is generated in the DAAD portal after the online application procedure has been completed, and other appendices by post to the application address.

Please note that the access to the application portal only appears while the current application period is running. After the application deadline has expired, the portal for this programme is not available until the next application period.
The access to the DAAD portal generally opens about 6 weeks before the application deadline at the latest.

Application documents

Certificates, proof of credits, certifications and translations may be scanned in non-certified form and uploaded to the DAAD portal. DAAD’s Head Office in Bonn will only request certified copies of the submitted documents in paper form if a grant is awarded!

1. Documents to be uploaded to the DAAD portal:

  • Online application form
  • Full curriculum vitae in tabular form (max. 3 pages)
  • Statement about academic and personal reasons for the planned study project in Germany (letter of motivation; 1 – 3 pages)
  • Letter of admission to a study programme; this can be subsequently submitted before the scholarship-supported study programme begins if it is not available at the time of application.

For a postgraduate or Master’s degree to be completed in Germany:

For a study period in Germany as part of a postgraduate or Master’s degree completed in the home country:

  • Proof that the academic achievements rendered in Germany will be recognised in the home country

Also for all applicants:

  • University degree certificate indicating final grade(s): the certificate must be subsequently submitted before the scholarship-supported study programme begins if studies have not been completed at the time of application.
  • Other documents you think might be of relevance to your application (e.g. certificates of employment, proof of placements)
  • Evidence of the applicant’s level of proficiency in German at the time of application. The certificate should preferably be issued by a Goethe-Institut or a DAAD-Lecturer, otherwise by a teacher of German. Applicants for an English-instructed degree programme are requested to submit an English language proficiency certificate.

2. To be submitted by post:

  • The “Application summary”, which is generated in the portal in PDF format and which can be printed out after the online application procedure is completed; please send 2 copy/copies to the application address
  • One recent reference from a university teacher which provides information about your qualifications (hand-signed, no digital or scanned signature); please enclose one copy of the reference in a sealed envelope with each copy of your application. A question often arises as to what is the difference between criminal law and criminology or between criminal justice and criminology. “DROIT PENALE: The Indian Law Journal on Crime and Criminology (ILJCC)”, aims to resolve this dubiousness by providing a wide range of well researched articles, case notes, commentaries etc. covering the major aspects and issues under the ambit of crime and criminology. The term ‘Droit Penale’, literally means criminal law. It has a French origin and deals with the various facets of crime and criminology. As a huge field of academic study, Criminology tends to cover criminal law and jurisprudence apart from dealing with crimes and criminal and socially deviant behaviour of criminals existing in the society. It also deals with the decriminalisation processes. While Criminal law mainly focuses on the punishments coupled or labelled with such a criminal behaviour.

The ILJCC, a student friendly law journal, has emerged bearing the idea to encapsulate an exhaustive approach towards all these fields. It aims at providing a detailed analysis and assimilation of various issues on a single rostrum contrary to the concept of dealing with fields of criminal law and criminology separately. PhD students are not just overloaded with course work; they are also forced to foot expensive bills for their mentors, take classes on their behalf and even abused sexually.

CHENNAI: A flight ticket and a suite at a star hotel. Mohan Ram* also had to ensure that a pick-up was arranged from the hotel. Later that evening he found himself buying his guest drinks at an expensive bar. All this hospitality ensured a prefix to his name. He is now Dr Mohan Ram*.

The life of a research scholars can be lonely and hard. In India, such students are further likely to face exploitation at the hands of several stakeholders in the process of earning their doctorate.

The recent alleged ‘sex for academic progress’ scandal involving an assistant professor at an Aruppukottai collage, is only the tip of the iceberg. While abuse can be of a sexual nature, it is common for research scholars to be subject to abuse of power in the form of emotional abuse, being made to take on additional work, run personal errands, or even offer bribes.

This exploitation is set up by the power that PhD supervisors exercise over a student’s research, progress and career. These guides are both the mentor who can support and facilitate the emotional processes; and the patron who manages the springboard from which the student can leap into a career. Students are dependant on them for everything from financial sanctions, networks and guidance.

While there are guidelines stipulating duration of PhDs, guides could stretch the project out for up to eight years. Many PhD students work on scholarships, usually available only for a certain period of time. “Students who are forced to finish majority of their work before their scholarship ends, need competent co-operation from their guides,” said former Anna University V-C M Anandakrishnan.

Thus, Mohan Ram, then a PhD scholar had to ensure a comfortable stay for the external examiner who conducted his viva voce test. Mohan, who pursued his research at one of the largest private engineering colleges in Tamil Nadu, said that he didn’t want five years of work going down the drain, simply because the examiner was in a bad mood.

“The examiner asked me to ensure a comfortable stay for him and my faculty-guide elaborated on what was the ‘industrial norm’ for a comfortable stay,” says Mohan, adding that he was scared of his thesis getting rejected.

Kaushik Sam*, who pursued his PhD at a private university in the outskirts of Chennai three years ago, met his PhD guide for the first time only two years into his research. “The professor I wanted as a guide was in high demand and so a faculty from my college, who knew the subject well, was my acting-guide. And he usually coordinated with the actual guide,” he said.

A former faculty of the university, on condition of anonymity said that he himself had been such an acting-guide. “While the University will not pay us for it, we will be listed as co-authors for that paper. This adds a lot to our academic resume,” he said. However, this means that the student’s research progress falls in the hands of a nodal faculty. Moreover, as doctoral students are not employees, they are not protected from employment legislation that prohibits staff bullying at work. Factors such as gender, social status, caste and network too influence the extent to which students get bullied.

Sexual favours

Anandakrishnan recalls firing a Chemistry professor after two female research scholars alleged that he was asking them for sexual favours. “The teacher went on to joining another university in a couple of years and my hands were tied,” he said. In October 2017, law student Raya Sarkar’s list, that went viral, revealed how often students felt sexually harassed by faculty. Sarkar had compiled a list of alleged sexual predators in Indian academia, claiming their victims had submitted their names to her. The list featured 58 academics from 29 Indian colleges, research centres and universities.

The alleged crimes listed against the professors ranged from verbal abuse to molestation and rape. Subsequently, students filed complaints before internal complaints committees against some of those named. For instance, prominent academic Lawrence Liang of Ambedkar University Delhi was held guilt of sexual harassment by that varsity’s sexual harassment committee.

Caste-based discrimination too pervades the research sphere. The issue caught national attention after Rohith Vemula, a research scholar at the University of Hyderabad, committed suicide in January 2016 following a controversy that had begun in July 2015 when the university reportedly stopped paying him a fellowship because an inquiry found that he had been “raising issues under the banner of Ambedkar Students Association.” His acquaintance J Muthukrishnan, from Tamil Nadu, committed suicide at Jawaharlal Nehru University last year. Dalit and marginalised students have spoken up about difficulties in being assigned supervisors, being poorly graded, or verbally abused.

Four committees

The chairman of All India Council for Technical Education Anil Sahasrabuddhe has said that every university must have a redressal mechanism for all kinds of bullying. “There are four committees mandated for any technical institute to get its license: The Internal Complaints Committee for sexual harassment, committee to investigate atrocities against SC/ST and minorities, anti-ragging and grievance redressal committee,” he said.

The earliest sexual harassment committees were formed in educational institutions based on Supreme Court guidelines framed as part of the case that led to the Vishakha judgement in 1997. Some of these were reconstituted and at most institutions, new internal complaints committees formed, after the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act was passed in 2013.
Bound by regulations, committees require “proper procedure” even for registering complaints. They must be submitted in writing or a statement should be recorded and signed.

There is no scope for an anonymous complaint registered without disclosing the identity of the complainant to the committee, the accused and witnesses. Once a complaint is received, a sub-committee of about three-four members, within the larger complaints committee, inquires into it. Not all varsities have such fully functional complaints committees, though.

Anandakrishnan suggested that a dean, who exclusively looks into research and development could prevent the extent of this exploitation. “The dean should be aware of the time taken for research by scholars, and why it’s getting delayed or why a lot of funds come in at a certain point The dean would basically be in charge of the dynamics of the PhD programme,” he said.

Student unions

Abuse against students can be prevented only when there is a strong student union, opines former vice chancellor of Manonmanium Sundaranar University V Vasanthi Devi. “A strong elected student body is the best immunity. The union must be able to give voice to individuals,” she said adding that efforts must be taken to have fair representation within the union. Such democratic student bodies help prevent harassment while preserving anonymity, according to a report of a committee headed by JM Lyngdoh, constituted by Ministry of Human Resource Developmen as per the direction of the Supreme Court of India.*-Names changed

Purpose

The objective of the internship programme is to provide a framework through which postgraduate students from diverse academic backgrounds may be assigned to the UNFCCC secretariat to enhance their educational experience through practical work assignments. It allows selected candidates to gain insight into the work of the United Nations and provides assistance and training in various professional fields.

UNFCCC secretariat’s internship programme is coordinated by the Administrative Services Programme and a designated focal point is responsible for liaising with the relevant substantive programmes for placement of interns. At the end of an internship period, both the intern and the staff member acting as his/her supervisor are required to submit an evaluation report to the designated focal point of the Internship Programme.

Eligibility requirements

  1. i) An undergraduate degree should have been completed with work on a Master degree in progress. Applicants should therefore be enrolled in a recognized university course of study in fields related to the work of the UNFCCC secretariat (including economics, environmental sciences, international law, international relations, natural sciences, political science, human resources and/or public administration, event management, IT/computer sciences, and communication) at the time of application and during the entire period of internship.
  2. ii) Applicants should be able to work in English.

Applicants pursuing their studies in countries where higher education is not divided into undergraduate and postgraduate stages should have completed at least four years of study and be a student at the time of application and during the internship.

Terms and conditions

  1. a) The normal duration of an internship is two months, which can be extended for an additional period of two months by mutual consultation and consent. The total duration may exceptionally be extended to a maximum period of six months when there are special academic requirements or special needs of the receiving programme.
  2. b) Applicants may not be related – i.e. spouse, mother, father, sister, brother, daughter, son – to a staff member of the UNFCCC secretariat.
  3. c) Upon selection for an internship placement, an ‘Internship Agreement’ is forwarded to the confirmed candidate for signature and returned together with proof of medical insurance coverage for the entire duration of the internship. This must be done prior to the agreed starting date.
  4. d) There is no promise of employment either during or upon completion of an internship with the UNFCCC secretariat.
  5. e) An intern with UNFCCC secretariat is not a staff member of the UNFCCC secretariat, therefore the privileges and immunities agreed between the UNFCCC secretariat and the host Government do not apply to interns.
  6. f) An intern undertakes to conduct himself/herself at all times in a manner compatible with his/her responsibilities as an intern of the UNFCCC secretariat.
  7. g) The intern is required to keep confidential all unpublished information made known during the course of the internship, and must not publish any reports or papers on the basis of information obtained, except with the prior written authorization of the UNFCCC secretariat. These obligations will not lapse upon the expiration of the internship period.

Expenses and medical coverage

Interns are not financially remunerated by the UNFCCC secretariat. Costs and arrangements for travel, visas, accommodation and living expenses are the responsibility of the intern or his/her sponsoring institution.

The UNFCCC secretariat accepts no responsibility for medical insurance for the intern or for any costs arising from accidents and/or illness during the internship period. Applicants are required to provide evidence of adequate medical insurance coverage.

The UNFCCC secretariat is not responsible for any claims by an intern or third party in the case of loss or damage to property, or death or personal injury as a result of actions or omissions on the part of the intern during the internship period.

Duties and responsibilities

Under the overall guidance of the Project Coordinator, the intern will support the implementation of projects through communicating with project partners, UNV Field Units as well as research and monitoring developments through different channels. Depending on the competencies and interests of the interns, assignments will include:

  • Assist with the collection and processing of project documents.
  • Support the coordination of project development.
  • Assist the preparation of workshops
  • Monitor, analyze and synthesize developments, press clippings and reports with regards to the relevant global policy frameworks and developments.
  • Develop reports or policy briefs with reviews of practices, lessons learned, and recommendations on good practices in relation to the integration of volunteerism into the relevant policy frameworks.
  • Research, collect, analyze and edit documents related to evidence of the impact of volunteerism on peace and development. Assist project activities at UNV HQ in general.
  • Take minutes and prepare presentations and documents for in-house committees and Field Unit.

Minimum Qualifications & Experience:

Education: Completed undergraduate degree (Bachelor) and current enrollment in a Master’s degree or equivalent. Only those students who will return to their studies upon completion of their internship assignments are eligible;

  •  Field of studyDevelopment-related fields such as economics, international relations,  anthropology, sociology, public or business administration, or environmental studies.      Other fields of study may be considered depending on the type of assignment.
  •  Language skills: Written and spoken proficiency in English and preferably in an        additional official UN Language (French, Spanish, Arabic, Russian, Chinese)
  •  Demonstrated interest in the field of development and the work of international  organisations.
  •  Previous experience in: organization of workshops/ events – partnership building and  stakeholder consultations – and/ or communications and campaign management – and/  or research and policy development as well as experience in developing countries is  desirable. – Knowledge of the UN work environment an advantage.
  •  Enthusiastic about the role of youth volunteerism and participation in peace and  development and ready to learn. Experience in non – formal education an asset.
  •  Good oral and written communications skills and demonstrated research abilities and  interest  Internet proficiency as well as proficiency in MS Office (Word, Excel,    PowerPoint) is required.  Experience with the development of statistics, charts in Excel    and Web 2.0 tools (especially social networking) an asset.
  •  Experience in volunteering a strong asset.

About the Summer School

About the organisers

Institute of Hazrat Mohammad (SAW):  The Institute of Hazrat Mohammad SAW is a research and advocacy think tank committed to peace and human development. Key focus areas of the Institute is human rights including rights of persons with disability, women empowerment and social justice. The Institute possesses over 15 years experience in working on human rights and women empowerment.  It is accredited as a civil society at the World Bank and a signatory to the United Nations Global Compact, the largest global sustainability initiative based on the Doctrine of Human Rights, Labour, Environment and Anti-Corruption.

Knowledge Steez: It is an organisation which has been actively involved in Human Rights  campaigns in India as well as in some other countries like Nepal, Turkey, Romania, Nigeria etc.  Apart from conducting legal awareness workshops, conferences, social awareness campaigns, we are also doing some research projects on Human Rights. Our team comprises of experts is Human Rights who have the exposure of conditions prevailing in various counties and they will be the trainers for the Summer School.

Why no probe yet in professor sex harassment case: Delhi HC to JNU

NEW DELHI: The Delhi high court on Wednesday pulled up Jawaharlal Nehru University authorities over their failure to start an internal probe against a professor accused of sexual harassment. Professor Atul Kumar Johri has been named in eight FIRs.

“What about providing an environment that is safe (for students)? He (professor) is a warden and some students in the hostel have said they feel unsafe. Is the vice-chancellor so helpless that beyond an internal complaint committee (ICC), he can’t act? He is the head of an educational institution,” Justice Rajiv Shakdher asked the counsel of the university when she claimed the administration could do little since students have not lodged a complaint with the committee. The court was hearing a petition by women students who are seeking Johri’s suspension and want his entry barred.

The petition has sought that a safe working environment be provided to students. “Would it not be advisable to tell the professor to stay out of the campus till the inquiry is completed? You can treat the representations as complaints. Core issue is that the students should feel safe in the campus. I am not saying you completely trash the professor. Take his defence, give him a preliminary hearing. Do something, you can’t expose your students like this,” the bench said.

Teacher arrested for molesting minor student in school

 

SURAT: Police arrested a 34-year-old teacher from an area under the limits of Umargam police station of Valsad district on Monday for allegedly molesting a class VI girl student of the school.

A teacher of Saraswati Hindi Vidyalaya Om Prakash Yadav was arrested by the police after parents of the girl student lodged a complaint against him at Umargam police station. The accused was booked under various Sections of Indian Penal Code and Protection of Children from Sexual Offences Act (POCSO).

The accused called all class VI students with their notebooks to the staffroom. He then sent the students back to the class except the girl. He allegedly closed windows and door of the staffroom and molested the girl, who shouted for help and ran out.

She then went home crying and informed her parents. The family members and other people reached school and demanded action against the teacher.

Meanwhile, the police reached the school and arrested the accused after registering the complaint of the parents.

The theme of the submissions should be within the ambit of Intellectual Properties Right.

Mobile phones stuffed in shoe soles, scalpel sewn into coat sleeves, drugs injected into tennis balls — these are just a few of the tricks jailbirds employ to smuggle contraband into India’s prisons.The Hinduinvestigates the mystery of India’s porous prisons where incarceration and connectivity seem to go together

In February 2014, a real estate developer made his way nervously to the prison ward of Mumbai’s St. George’s Hospital. He had recently bagged a Slum Rehabilitation Authority project, a lucrative business opportunity in one of the world’s most expensive housing markets.

For over a month, he had been getting threatening phone calls from the “underworld”. They ordered him to pay a hefty extortion amount or stop work on the project. When he refused to pay heed, a henchman turned up at his doorstep. The builder was forced to accompany him to the hospital. Awaiting him in the prison ward, in perfect good health, was Ravi Mallesh Bora alias D.K. Rao, a top aide of gangster Rajendra Nikhalje alias Chhota Rajan.

Three years later, in 2017, the builder finally approached the Mumbai Crime Branch. Its Crime Investigation Unit found that Rao had been comfortably running his extortion racket from Taloja Central Jail in Navi Mumbai, where he had been lodged for years. He had also been in direct touch with his boss Rajan, who was giving him instructions and seeking regular updates on the dhandha(business).

This revelation of the prison cell serving as Rao’s ‘office’, however, wasn’t an unexpected one. In 2015, a surprise check of Rao’s cell at Taloja had unearthed three mobile phones. The call records showed he had made hundreds of calls over the last three months, many of them to international numbers. The builder’s complaint in 2017 only further confirmed what the police already knew: prison is not even a speed bump for criminal elements who know their way around.

But it isn’t only established international criminal syndicates such as Rajan’s that run their operations from inside prisons. Local gangsters do it too. The name Uday Pathak, though not as widely known as Chhota Rajan or Dawood Ibrahim, still strikes fear in northern Mumbai’s Kurar and surrounding areas.

Turf control

In June 2011, Pathak and his gang kidnapped four men of a rival gang to avenge a petty insult. They took them to a forest area near Kurar, tortured and mutilated them, and finally burned their bodies. Pathak was arrested and was undergoing trial when he learned that some local toughs were trying to take over his area. He arranged for mobile phones and relayed instructions to his friends on the outside to make it known that he was still a force to reckon with. This was in mid-2015.

So, a few months later, in November 2015, a gunman walked up to a construction site in Kurar, fired a single round, dropped four pieces of paper on the ground and fled the scene. One of the notes had the name Uday Pathak scribbled on it, with a demand for money. The other three had the names of local political figures and businessmen, indicating that they too could be Pathak’s targets.

Other examples of hit jobs being ordered from prison include those of Yusuf Suleiman Kadri alias Yusuf Bachkana, also a Chhota Rajan aide, who, in 2013, ordered a hit on a Mumbai builder for refusing to pay extortion money; and Prashant Rao, an aide of gangster Yusuf Lakdawala, who instructed three of his henchmen to kill a businessman for the same reason in November 2016. Bachkana was then lodged in Hindalga Central Jail in Belgaum, while Rao was in Nashik Central Jail. Luckily, the targets in both the cases survived the attempts on their lives.

Clearly, these gangsters wouldn’t have been able to order hit jobs and communicate with their associates unless they had access to mobile phones — an access that is illegal. So how did they manage to get their hands on one?

In the sprawling 212-acre complex of Chennai’s Puzhal Central Prison, undertrials were being lined up for security check at the gate. Under the watchful eyes of the warders, they walked through the scanning machines one by one.

A prisoner who passed through the metal detector without triggering an alert caught the guards’ attention. There was something unusual about his gait. Suspecting foul play, prison officials searched him. They found nothing on his body. A careful examination of his footwear revealed that one of the shoes had been customised to accommodate mobile phone components. He had cut open the grooves in the sole to fix a handset, battery, and charger. He had been trying to walk without giving putting too much weight on one of the shoes, the one with the mobile phone parts. This ended up arousing suspicion and led to the exposé.

This is just one of several options used by prisoners to smuggle prohibited articles into prison. Despite thorough frisking, round-the-clock security, watch towers, and an extensive CCTV network, inmates sneak in contraband at will.

But it’s not only phones that are sneaked in. A 21-year-old ex-inmate who spent over six months in Delhi’s Rohini district jail in 2017 recalls how “everything that’s small in size” was smuggled inside. “Be it drugs in the form of powder or pills, mobile phones, or pocket knives.”

Three layers of checking

Sitting in his East Delhi home, the undertrial, who was in jail on charges of rash driving and attempt to commit culpable homicide, shares a story about how a fellow inmate managed to take a scalpel into Rohini prison.

“He is not a noted criminal,” he says, refusing to take names. “But he has been in and out of prison several times. All the warders knew him personally. Now, anyone who comes to the prison goes through three layers of checking before they meet the prisoner. But often, if a lawyer has been visiting regularly, he can get in without a thorough check,” he says. “You have to understand that there’s a nexus at play here.”

He said that in this particular case, the advocate had concealed the scalpel on the inside of the right arm of his black coat, after making an incision in the cloth. When he reached the room where the prisoner was waiting for him, he told the warder that he needed the prisoner to sign a document. “The prisoner signalled to the warder to let him sign in person instead of the document being carried to him by the jail staff. The warder agreed. The prisoner and the lawyer met and ‘shook hands’. And the scalpel passed from the lawyer to his client.

“The warder knew what was going on,” claims the young undertrial out on bail, adding, “They play a major role in the movement of contraband into and within the prison. Parents, relatives and other visitors can also transfer contraband like the lawyer did, provided they have connections.”

But the smuggling of contraband into jail premises doesn’t necessarily have to be through the main gate. Court meetings are a popular rendezvous used to transfer drugs and phones to prison inmates. If that proves too tough to manage, you could simply chuck stuff into the prison. If you have a good arm, you can fit whatever it is into a tennis ball and throw it, like a fielder at deep fine leg hurling the ball to the wicket-keeper.

“Some prison walls are accessible from the road,” points out Ajay Kashyap, Director-General of Tihar jail. “For instance, one of the boundary walls of Rohini jail is close to a flyover. Often, tennis or Cosco balls are recovered from the prison backyard. We have found them filled with a note or small articles,” says Kashyap, adding that if a prisoner is found with such balls, he is immediately punished. He either has some of his perks — such as what he can buy from the canteen — reduced, or is denied meetings with his family.

A.G. Maurya, former Deputy-Inspector General (DIG) of Prisons, Tamil Nadu, echoes Kashyap’s point that contraband is often thrown into the prison campus.

“Puzhal Central Prison is a huge campus. It has deserted places full of thick vegetation, where construction materials have been dumped, and even some unused buildings. When the prisoners go to the court for remand extension every 15 days, or meet visitors at the prison, they fix on a date and time when their contact will throw the parcel containing mobile phones, cigarettes or drugs. They even co-ordinate this using mobile phones already smuggled into the prison,” says Maurya, adding that inmates have full knowledge of the prison topography and the places that are beyond the reach of surveillance. “Sometimes they even pick up a parcel after a few days. The guards can’t patrol the whole campus all the time. A few places are not visible to the armed guards on watch towers.”

Lucrative barters

But why do inmates resort to such smuggling knowing full well that they will spend more time in jail if caught? Is it primarily to run their criminal activities, as in the case of the Rajan gang members? Is it to protect themselves? Or is it just addiction — either to mobile phones or drugs? Prison officials say that money is the big driver.

A cigarette that retails for Rs. 10 in the outside world is worth 10 times more inside the prison. “It is the addiction of other inmates to tobacco that makes some prisoners take the risk of smuggling. They get to make at least 10 times the money they invest in smuggling these substances. The income earned is paid to the families outside. This is a working revenue model,” says an official from Puzhal prison.

Prisons also tend to have a vibrant barter trade. An inmate might offer a pack of beedis in exchange for being able to make a phone call to his family. Another will offer WhatsApp on his phone for an hour in exchange of drugs. Sometimes, however, the motivation could be as simple as wanting to take a selfie.

In March this year, the administration of Uttar Pradesh’s Muzaffarnagar district went into a tizzy after a rather unremarkable selfie went viral. The photograph showed three young men trying to squeeze into the frame against a dimly lit background.

One of the three men in the photograph, Vijay Choudhary, was an undertrial at the time, lodged in the district jail on charges of attempt to murder. The other two had murder charges against them. While the selfie has sparked an official probe, jail officials believe the mobile phone was thrown into the jail from outside the boundary wall, which is close to a densely populated area, by another undertrial who was out on bail.

Back in February, in an almost identical incident, an undertrial lodged in Basti district jail posted a selfie with two murder convicts. In this case, too, a probe has been ordered. Officials suspect the inmates could have received the mobile phone from an outsider during visiting hours. The role of the guards is also being investigated.

On March 15, Tamil Nadu’s Prison Department informed a Division Bench of the Madras High Court that it had brought down the number of illegal mobile phones and SIM cards recovered from the State’s prisons from 836 and 646, respectively, in 2013 to 288 and 209 in 2017. On hearing the statistic, Justice V. Parthiban asked, “Fine that you have seized these many cell phones and SIM cards, but how did they get into the prisons in the first place? Is it because of laxity or connivance of the officials?”

Well, prison officials from five States — Tamil Nadu, Uttar Pradesh, Maharashtra, Delhi and West Bengal — point to three factors as primarily responsible for the rampant smuggling of prohibited articles into prisons: corruption and laxity among jail officials, lack of an adequate number of guards, and overcrowding of the jails.

P.K. Mishra, Inspector General of Prisons, Uttar Pradesh, candidly says that lapses take place “only because of human error, either through negligence or corruption.”

Manpower crunch

An official with a Mumbai prison says that in a jail, which is a world unto itself, a well placed currency note here and there can go a long way in ensuring a comfortable life, be it for undertrials or convicts. Rao, for instance, was in prison to serve a sentence in an extortion case. But thanks to mobile phone access, he could spend his jail time running Rajan’s extortion racket.

“Manpower is also an important factor,” says the official who did not wish to be named. “While there are several vacant posts in the Prisons Department, almost all the prisons in Maharashtra are filled beyond capacity. Managing such a large number of prisoners is not always possible. Those with the means to bribe prison guards waste no time in doing so, and they reach a tacit understanding. The prisoner also ensures his activities remain under the radar so that the guards do not get into trouble. As for the guards, they do everything from turning a blind eye to actively helping the smugglers.”

Overcrowding and understaffing are definitely critical issues in Uttar Pradesh. The State has 70 jails. Their total sanctioned capacity is 58,000. But the actual number of inmates is almost double that. At the same time, as against the required staff strength of at least 9,000 warders, the State has only 4,000. With such mismatched numbers, combating smuggling was never going to be easy.

Smuggling a prohibited article into a prison is a punishable offence under Section 42 of The Prisons Act, 1894. The list of prohibited articles is long and varied: apart from mobile phones, it includes drugs, intoxicants, alcoholic drinks, smoking pipes, wireless sets, metal, expensive jewellery, arms and ammunition, explosive materials, and even items as innocuous as a rope or a pen nib.

But if the use of mobile phones in prison is both illegal and widespread, it raises an obvious logistical question: how do these inmates charge their phones, that too without getting caught?

  1. Duraisamy, who retired as DIG of Prisons a couple of years ago, says there are only two possibilities: either the jail warders help the inmates for a fee or the prisoners charge the phones in their cells. “Since the cells now have lights and fans, some prisoners know the technique of pulling out live wires and using them for charging the phone. Once the charging is done, they manoeuvre the wires back to their original position.”

To the question of how many of the contraband seizures have resulted in convictions, prison officials say that on most occasions the prisoners plead ignorance even when the seizures are made in their own cells. So such seizures would have to be treated as abandoned articles until technical evidence proves otherwise.

So what’s the best remedy? As if to underscore Tamil Nadu’s statistics, Mishra says that over the years, smuggling cases have been reduced substantially by checking instances of human error. This has been done through two means — punishment and posting.

In Uttar Pradesh, officers found incorrigible were ordered compulsory retirement or even terminated from service, while more competent officers with a higher level of integrity were posted in more sensitive jails, says Mishra. The State is also looking at a technological fix. On April 5, it sanctioned additional CCTVs in 43 jails across the State, at a cost of Rs. 2.4 crore.

Will legislation help?

West Bengal, which has one of the highest prison occupancy rates in the country (102.9% at the end of 2015), is so vexed with the problem of mobile phones being smuggled into prison that it is considering a special legislation to tackle the problem.

A senior officer with the West Bengal Correctional Homes administration said that during the 22 months that he was in charge, about 1,000 unauthorised mobile phones were recovered from prison inmates. On an average, 600-700 mobile phones are seized every year from the State’s prisons.

So, West Bengal is considering an amendment to The West Bengal Correctional Services Act, 1992, making the possession of mobile phone by an inmate a punishable act. The amendment has provisions mandating additional jail term for inmates found in possession of mobile phones.

Maharashtra Prisons Department uses a different strategy — cultivating its own informants among the prisoners, who pass on timely information. The informants, however, lead a highly risky life as the slightest suspicion can result in death in the middle of the night.

The general wisdom among prison administrators seems to be that even with CCTV cameras, informers, rigorous checks, and upright warders, smuggling cannot be controlled beyond a point given the sheer number of inmates in Indian prisons. Tihar’s top boss Kashyap sums it up, “Where there is human involvement, 100% perfection is not possible.”

Vigilance officials laid a trap after an assistant professor complained that the vice-chancellor had demanded a bribe from him

CHENNAI:  The vice-chancellor of Bharathiar University in Coimbatore, Dr A Ganapathi, has been arrested after he was caught taking a bribe for regularising the service of an assistant professor who is on probation. The arrest was made by officials from the Directorate of Vigilance and Anti-Corruption after the assistant professor approached them. “A trap was laid to catch the vice-chancellor red handed after Suresh, an assistant professor in the Chemistry department, complained of a demand for bribe for securing his position,” a senior officer told NDTV.
“The vice-chancellor demanded Rs. 30 lakh as bribe. He received a token of Rs. 1 lakh in cash and the balance as post-dated signed cheques, the payee column left blank,” an officer said. The appointment of vice-chancellors in the state had come under the scanner over the last several years. Academicians and activists have alleged that political clout and money power have influenced the appointments, leading to a decline in standards and increase in corrupt practices at universities.
Recently, during his tenure as Tamil Nadu Governor, Vidyasagar Rao rejected the names proposed by a search panel for the appointment of vice-chancellor to Anna University in Chennai. Mr Rao had appointed a committee headed by former Chief Justice of India Justice RM Lodha to recommend suitable names for the post.

The vice-chancellor who was arrested today earlier headed the biotechnology department at Bharathidasan University. He took charge as vice-chancellor of Bharathiar University in 2016. Last year, he was booked under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 after a Dalit research scholar had complained that he deliberately scuttled her chances of becoming an associate professor.

Supreme Court website hacked

 

The website, which had turned “non-functional” from 11.35 a.m., became accessible only at around 7.50 p.m.

The Supreme Court website was hacked a little before noon on April 19, an official of the Electronics and IT Ministry said. The official said the Supreme Court had its independent systems and these were not managed by the National Informatics Centre (NIC), which comes under the Ministry. “CERT-In [the cyber security arm of the government] has advised the Supreme Court official on the steps to restore the website,” the official said. It could not be confirmed who hacked the website.

The website, which had turned “non-functional” from 11.35 a.m. IST, became accessible only at around 7.50 p.m.

One of the screen shots of the top court web page circulating on some social media sites showed signs left by some Brazilian hackers who may have targeted it. An image of cannabis leaves, with a message saying “hackeado por HighTech Brazil HacTeam”, could be seen.

Later in the day, when attempts to reach the website at supremecourtofindia.nic.in was made, the result read: “site under maintenance“.

The website had gone down, hours after a bench headed by Chief Justice Dipak Misra delivered a hard-hitting judgement relating to the death of special CBI Judge B H Loya, who was hearing the Sohrabuddin Sheikh encounter case.

The journalists who were waiting for the verdict to be uploaded on the site made frantic queries with the concerned authorities about the suspected hacking.

While the officials remained non-committal about the hacking and as the time was ticking away, a press note was issued from the apex court registry that while the website remained non-functional. The registry sent soft copies of the judgement to the media in view of the “unavoidable circumstances” due to non-functioning of the website.

The registry said that the official website stopped fun

ctioning “due to some technical snag”. Normally, the orders of the day are uploaded on the site every evening.

The judgement was, however, was uploaded on the internal server of the apex court at 1.15 pm, in public domain, it said, but the scribes were informed about the availability of the judgement an hour after the normal court hours, that is 4 pm.

“Queries were received in the registry regarding the time by which the judgement could be accessed from the official website. The technical team was continuously on the job to rectify the official website page online.

“As the process of restoring the official website would have taken some more time, it was decided to dispense soft copy of the judgement to the media persons through the undersigned. The copying branch of the Supreme Court was also instructed to provide copies of the judgement to anyone making request in that behalf.

“These steps have been taken by the Supreme Court Registry in view of the unavoidable circumstances due to non-functioning of the official website,” it said.

Salma Khan: First transwoman on Lok Adalat panel

 

A postgraduate with a Masters in Social Work, 40-year-old Salma Khan was chosen from among 16 transgender candidates, and she will attend the panel’s second hearing on April 22.

On February 10, Salma Khan was appointed a panel member for Lok Adalat at the Mumbai District Suburban Legal Services Authority (DLSA), the first transgender woman in Mumbai to do so. She joined a league of transwomen who have broken social barriers, like Joyita Mondal, a judge from West Bengal, and Amruta Alpesh, an advocacy officer in Chattisgarh. A postgraduate with a Masters in Social Work, 40-year-old Khan was chosen from among 16 transgender candidates, and she will attend the panel’s second hearing on April 22.

Khan is among three panelists in Court Number 1 at the Lok Adalat, which is an alternate dispute redressal system in Bandra, mostly dealing with cases of loan defaulters and other banking matters. As per the National Legal Services Authority, at the district level, each bench of the Lok Adalat should comprise a sitting or retired judicial officer, a member from the legal profession and a social worker engaged in the upliftment of weaker sections. Having worked with transpeople since 1986, Khan is currently the president of Kinnar Maa Samajik Sanstha Trust, which she founded in 2014.

“Despite, the Supreme Court judgment in 2014 recognising the rights of transgender persons, social change has not been swift for the community and we are still vulnerable. Despite educational qualifications, many who identify as transgender do not find it easy to find employment. My appointment on the Lok Adalat panel should help others in accessing such spaces to increase our representation,” says Khan.

Recalling her first hearing in February, Khan says while her co-panelists and others supported her, she also got a few curious glances. “When I sat on the panel, some people stared at me in confusion but most were happy to see me there. My co-panelists and others made me feel comfortable. I am looking forward to the second hearing this month,” said Khan. From her work with various organisations including The Humsafar Trust, to her time counseling transgender youth at Sion Hospital, Khan says she has seen many struggle to find acceptance among people despite being qualified.

“In a recent case, a transgender woman in Mumbai got a job at a call centre but when they learnt her identity, they told her they cannot hire her. I hope the government can pave the way by giving jobs for transgender persons so that other private offices can also not discriminate,” she says. Khan, who grew up in Mumbai — her father worked in the RTO and her mother was a housewife — says she gained higher education with her mother’s support. She aims to pursue a doctorate in law, but her next focus is to work towards the rehabilitation of older people in the community.

“I have been petitioning the state government to provide homes for aged hijras, with health support and safety. There are shelter homes for women but older members of the community have nowhere to go. These are aspects that nobody has paid attention to and I hope that the government will soon intervene with a policy,” says Khan. She says she also hopes that with the community’s increased representation in legal spaces, there can be more policy changes for them.

“When the Indian society sees us, all they see are singing, clapping hijras who beg or go door-to-door to bless families. It has been seventy years since Independence, but no one has thought about uplifting our community. Give us scholarships, education, jobs and pensions so that we too, can lead dignified lives. We are what we are today because of the negligence of this society. The past is the past, and that is fine. But we don’t want our future generations to suffer as we did. We do not demand your pity, we only want our rights,” says Salma.

In an effort to encourage and empower young individuals to play their part in helping the community through green activities and initiatives, GreenMatch would like to award a student with a scholarship of £1,000 for excellence in green initiatives.

 

Eligibility Criteria

Applicants are required to submit the following documents along with their application:

  1. Participants must provide proof that they are either currently enrolled or have been accepted at an accredited university in 2018.  2. Applicants must submit pictures or documents of a community service act that they have been a part of, along with their application. 3. An essay describing a community service activity that you have participated in.

How to Apply

In order to apply for this scholarship applicants are required to write an essay of 1,000 words.

Topic: Describe a community service activity or initiative that you have participated in.

The following points should be taken into consideration while writing the essay:

  1. What does green living mean to you? 2. Why do you think this specific community service activity is important, and what should people know about it?
