News-Bangladesh Cabinet Approves Death Penalty For Rape Convicts After Nationwide Outrage.

Bangladesh’s cabinet has approved the proposal to increase the maximum punishment in rape cases to death from life imprisonment after widespread anger across the country due to a rise in sexual assaults. The in-principle approval was reportedly given at a cabinet meeting chaired by Prime Minister Sheikh Hasina.

“Bangladesh Law Minister Anisul Huq told reporters that the proposed law stipulates that “the maximum punishment is death penalty for the sex offenders.” Bangladeshi President Abdul Hamid is expected to promulgate an ordinance, amending the Women and Children Repression Prevention Act, on October 13 to enact the increased punishment for rapists.”

Currently, capital punishment in rape cases can be sought only if the victim dies after the assault. A series of violent sexual attacks in Bangladesh triggered protests in Dhaka and other major cities, demanding strong action against perpetrators. Local women’s rights group Ain-o-Salish Kendra (ASK) said that 975 rapes, including at least 208 gang rapes, occurred between January and September. As many as 43 of the rape victims died after an aggravated assault and 12 committed suicide, the rights group says on its website.

Introduction:
The post of Judge Advocate General in India is held by a Major General who is the legal and judicial chief of the Army. The Indian Army has a separate JAG branch which consists of legally qualified army officers. Officers can either be commissioned directly into the JAG Branch or can be sidestepped from other branches, arms or corps. JAG officers provide legal help to the military in all aspects, in particular advising the presiding officers of courts-martial on military law.

Eligibility:
1.Must be an Indian.

The Editorial Board of the NUALS Law Journal (ISSN Number 2319-8273) is inviting submissions for its 15th Edition. The Journal, being the flagship law review of the National University of Advanced Legal Studies, is a multidisciplinary, double-blind, peer-reviewed journal.
Submissions are invited on any topic of law of contemporary relevance, from academicians, legal practitioners, students and researchers from the legal community. All submissions will go through a rigorous review process and possible editing by the Editorial Board.

Categories:
The journal accepts submissions under the following categories:
• Articles of length: 5000 – 10000 words (exclusive of footnotes; however speaking footnotes must be limited to 50 words); articles exceeding the word limit may be considered on merit.
• Short Notes (between 1500 and 5000 words)
• Case Comments (minimum of 1500 words)
Longer submissions may be considered on the basis of merit.

Notes from the Field – Notes from the Field are pieces designed to provide a glimpse into a new legal strategy, political initiative or advocacy technique applied in the field, a current problem or obstacle faced in legal reform or development work, or a new issue that has not yet received much attention and needs to be brought to light. For contributions in this category, empirical studies are encouraged.
All manuscripts must be submitted in a .doc or .docx format. The manuscripts must necessarily be accompanied with the author’s biographical information in a separate title page and an abstract of not more than 250 words.
For formatting and citation guidelines, please refer to SLR’s style guide.

Deadline:
The last date for submission of manuscripts for Volume 17(1) is September 15, 2020. Submissions sent after this will be considered for publication in Volume 17(2).

Contributions to SLR must be made in the electronic form only. Please mail contributions to sociolegalreview.nls@gmail.com, with the subject ‘Submission for Socio-Legal Review – Volume 17(1)’.

Timeline and Procedure:
SLR strives to ensure a speedy and efficient review process. We follow a system of two rounds of internal reviews by the Editorial Board. If approved in both rounds, the manuscript is then subjected to two double-blind peer reviews simultaneously. Authors should be prepared to make suitable changes to their manuscripts as required by the Editorial Board before publication.

Conditions of Publication:
Please note that manuscripts not conforming to these guidelines may be returned or rejected. While we strive to provide substantive feedback for every manuscript we receive, it may not always be possible to do so, given the large number of submissions. We reserve the right to reject manuscripts without providing substantive feedback.
Please note that in the event that a manuscript submitted to SLR has been submitted and accepted by any other Journal, the author must withdraw their submission from SLR. If SLR accepts the manuscript first, the author must withdraw it for consideration from all other Journals. Failure to do so will lead to removal of the piece for consideration for publication in SLR.

The above-mentioned list of sub-themes is merely suggestive and not exhaustive. The authors are at liberty to make submissions on issues which come within the ambit of core-themes mentioned above.

Submission Categories:
1. Articles: (5000-10000 words, inclusive of footnotes): The papers in this category must comprehensively and critically analyse the theme that the author seeks to contribute. They may be either doctrinal or theoretical (or both) specifically dealing with contemporary and academic issues in international law and related disciplines.
2. Essays: (3000-5000, inclusive of footnotes): The paper should be concisely in terms of scope and conceptualisation of the theme intended to highlight by the author. The essay seeks to solve existing paradigms and contemporary issues in international law and related disciplines.
3. Case Comment: (1000-3000, inclusive of footnotes): The paper related to the case comments should comprehensively deal with the study of contemporary or landmark judicial pronouncement by International Court of Justice, International Criminal Law, Regional Human Rights Court, International Tribunal for Law of Sea etc.
4. Book Review: (1500-3000, inclusive of footnotes): A critical review may be undertaken concerning the book published in the field of international law and related disciplines.

Guidelines for Submission:
The theme of the submission should be within the ambit of the core-themes mentioned above.
1. The submission should be unpublished, original and should not be under consideration elsewhere.
Submission should be made in the electronic form to editorialboard.ijlia@outlook.com under the subject heading “IJLIA Vol.4 Issue 2” submission ‘Paper Title’.
2. All the submission must be in MS Word format (.doc) or (.docx) with the Times New Roman Font (Main text: size 12 and 1.5 spaced, footnotes: size 10 and single-spaced).
3. Page borders should not be used.
4. An abstract of not more than 300 words should be accompanied in the paper.
5. Co-authorship (up to 3 authors) is permitted.
6. All the manuscripts must be accompanied by a cover letter with the name(s) of the author(s), institution/organization, the title of the manuscript and contact information (email id & phone number)
7. No personal information or references, including name(s) of the author(s), institution/organization and contact information be mentioned in the text of the manuscript and file name.
8. Manuscripts with plagiarism above 25% shall be summarily rejected.
9. All the manuscript must comply with the Harvard Blue Book citation (20th Edition) for footnotes. The non-compliance to the citation of footnotes shall be subjected to rejection.
10. Every submission of the manuscript shall be acknowledged within 48 hours and subject to the preliminary review process by the peer review group.
11. In case of acceptance or rejection, the authors of submitted manuscripts shall be informed about the status of peer-review of the manuscript not later than 30th August 2020.
12. In case the submission is accepted, the editorial board shall inform the author of editors’ feedback/comments and authors shall be afforded a reasonable time to submit the revised draft keeping in mind the editor’s comments.

About Edited Volume:

Centre for International Trade Law of National Law University Odisha proposes to bring out an edited book with a multidisciplinary approach on Fisheries Conservation and Trade in Fisheries: Towards Sustainable Use. Sustainable use of natural resources is very pivotal for ensuring long term prosperity and to prevent extinction of resources. Fisheries are one such natural resource which is over exploited. There is no doubt that fisheries have contributed significantly to global food security, livelihoods for many and not to mention the economy of the country. Fisheries play a crucial role in ensuring food security, employment as well as in livelihood in many countries, especially in developing countries and least developed countries. There has been a growth in seafood trade with the increased exports from the developing countries and with the advancement in storage and preservation technologies.

There is a growing interconnectedness between trade and resource conservation and the WTO can play a pivotal role in resource conservation. This has been evidenced in the WTO in United States- Import Prohibition of Certain Shrimp and Shrimp Products case. A healthy balance may be achieved if fish stocks are maintained within sustainable limits. The percentage of world marine fish stocks within biologically sustainable levels declined from 90 per cent in 1974 to 69 per cent in 2013. It is absolutely essential to achieve sustainable fishing not just for protecting the marine environment and the livelihoods which depend on fish stocks but for the World Trade Organisation as an institution itself if does not address a pressing environmental problem. Even the Goal 14 of the Sustainable Development Goals relates to ‘conserve and sustainable use the oceans, seas and marine resources for sustainable development.’ To achieve this goal, certain targets and indicators were identified and accordingly target 14.4 and target 14.6 is relevant to fisheries conservation. Thus, there is an imminent need to balance the trade needs of a country, its food security and fisheries conservation. The proposed book aims at espousing the need for such a balance.

Suggested Theme:

We invite original unpublished papers that may address one or more of the following themes:

Only original papers will be accepted for publication. Revised version of papers that was published earlier will not be accepted. PREAMBLE:

 As we all know that law is a complex subject, especially for laymen. Efforts are being made to simplify the same for the benefit of the larger public. Many a time it becomes difficult to understand the legal language because of usage of the legal words which are derived from Latin, French, English language which is in use for decades. Law Curriculum covers subject on Legal Language in the very first year of the study in law school. This subject is utmost important to understand the law and its intricacies but we have been witnessing the scenario that this subject is not very well taken in most of the law schools. Most of the time it is left to the students to study on their own which leads to difficulty in understanding various law subjects in the subsequent study and as well as in practice. This situation needs urgent attention and come up with some feasible solution. The main objective of the present competition is to discuss and deliberate the challenge faced by legal education in the linguistic aspect.

 SUBMISSION GUIDELINES:

 1. Students of Five/Three years law, LL.M., M Phil, PhD can participate in the said competition. Only one co-author is allowed.

The Friedrich Naumann Foundation (German: Friedrich-Naumann-Stiftung für die Freiheit) (FNF) is a German foundation for liberal politics, related to the Free Democratic Party. Established in 1958 by Theodor Heuss, the first president of the Federal Republic of Germany, it promotes individual freedom and liberalism. The scholarship is named for Melbourne alumnus the Hon Alex Chernov AC QC, former Governor of Victoria, Judge of the Court of Appeal of the Supreme Court of Victoria, and chancellor of the University of Melbourne. After a celebrated career at the Victorian Bar punctuated by leadership and service to the community, Mr Chernov was instrumental in founding the Australia India Institute, serving as Chair of the Institute from 2008-2011 and as its Patron from 2011 onwards.

Eligibility:

To be eligible for this scholarship, you need to:

  • be an international student from India, and
  • have applied for, and been offered a place in a Masters-level course from within the various specialist legal areas of the Melbourne Law Masters program at Melbourne Law School:
  • if commencing in the start-year intake (March), your application for your chosen course must be submitted by 31 October the year prior.
  • if commencing in the mid-year intake (July), your application for your chosen course must be submitted by 30 April of the same year.

Selection criteria:

Selection will be based on academic merit.

Value:

The Society of Law and Literature, National Law University Odisha, Cuttack is pleased to announce its first collaboration with ProBono India with regards to the Article Writing Competition on the tentative theme “Teaching of Legal Language in Indian Law Schools needs Urgent Attention”.

ProBono India is India’s first platform that started in 2016 and which focuses on highlighting all legal aid and awareness activities around the world on one platform. It is a platform which provides free legal aid service to serve the needs of people. The objective of the organization is to provide legal aid, conduct legal awareness activities, disseminate legal aid, promote legal awareness activities of various organizations of the world and conduct research on all aspects of legal aid and legal awareness.

The Society of Law and Literature, National Law University Odisha, Cuttack was established in the year 2020. The objectives of the Society are to create an atmosphere where literature is to be read and promoted through artwork, theatre, article writing, article/book review, film making, street play and the analysis of the literary aspect of judgments, to publish a cumulative research paper inclusive of new findings and the emerging topics by bridging the gap between literature and law and to create a forum where literary activities can be conducted and promoted.

OBJECTIVE OF THE COMPETITION:
As we all know, law is a complex subject, especially for laymen. Efforts are being made to simplify the same for the benefit of the larger public. Many a time it becomes difficult to understand the legal language because of the usage of legal jargon which is derived from Latin, French and English languages and which are in use for decades. The Law Curriculum covers a subject on Legal Language in the very first year of study in a law school. This subject is of utmost importance to understand the law and its intricacies but we have observed that this subject is not very well received by students in most law schools. Most of the time it is left to the students to study on their own which leads to difficulty in understanding various law subjects while subsequent study, as well as, in practice. This situation needs urgent attention and we can come up with some feasible solutions. The main objective of this competition is to discuss and deliberate the challenges faced by legal education in the linguistic aspect.

SUBMISSION GUIDELINES:

  • Students of Five/Three Years’ law, LL.M., M Phil, PhD can participate in the said competition. Only one co-author is allowed.
  • The word limit for an article should be between 1200 to 1500words.
  • Font type should be Times New Roman, Heading size is 14, Text size is 12, Spacing is 1.5, Footnote is size 10, and no spacing is allowed.
  • All references are to be mentioned in the footnote and using OSCOLA referencing style only. Any plagiarised article will be outrightly rejected.

Use Zoom at your own risk: Privacy concerns around this viral video conferencing app

About:
Zoom video conferencing has been the talk of the town for weeks now. Due to the ongoing lockdown globally, Zoom’s popularity quickly shot up as people used it for meetings and students for online classes. However, Zoom was soon discovered to have many security loopholes.
Zoom’s CEO Eric S. Yuan even apologised for all the security issues that the video conferencing app was packed with. Zoom also announced a 90-day feature freeze to focus on security and privacy. The company also rolled out two new features aimed at making the app more secure. However, schools in the US decided to ban the video conferencing app for their online classes.
If you’re still using Zoom, these are some security issues you should be aware of.

Zoombombing:
Probably the most popular Zoom security issue is zoombombing which lets just anyone easily hack into meetings and show inappropriate content. While the meeting host can remove these users from the meetings, they often come back with new accounts. This is possible because Zoom requires meeting IDs which if out in the open becomes very vulnerable.
To fix this, Zoom actually rolled out two new features which enhances the usage of passwords for video meetings. It’s also advised that users don’t share meeting IDs in public, and keep them password protected.

End-to-end encryption:
A report by The Intercept revealed that Zoom’s meetings aren’t end-to-end encrypted as the company claimed. Zoom later clarified that it’s concept of end-to-end encryption is different from other companies. In simple terms, Zoom data is decrypted at the server which makes it possible for the company to see and hear conversations. The company however assured that it doesn’t decrypt user transmissions.

Email addresses, profile photos leak:
Users who share the same email domain will find their email addresses in a universal company folder which is visible to all the members. This doesn’t work for major email clients like Gmail, Yahoo, Hotmail or Outlook. But this isn’t the case for users who use small email clients. It happened to Dutch Zoom users who could see information like email addresses, usernames and even photos of them and others in the company folder. These users reportedly used ISP-provided email addresses.

Selling user data:
Zoom’s privacy policy was revealed to have clauses which give the company full right to share user data with third-party marketers. Once this was revealed, Zoom reworked its privacy policy removing those bits and stating that it does not sell user data.
