The Asser Institute is a research center for the international and European law. Its mission is to contribute to the development of international and European law by conducting independent fundamental research, policy-oriented research, and applied legal research, as well as by initiating and facilitating academic and expert meetings, (professional) education, and public events with a view to disseminating knowledge of international and European law. The Institute is dedicated to building a strong research community and creating an environment that facilitates critical-constructive reflection.

The Institute invites applications for a (Postdoctoral) researcher Full-time (38 hours per week). Available from 1 September 2018 to assist on the MELA (“Memory Laws in European and Comparative Perspectives”) project run by the T.M.C. Asser Institute (http://www.asser.nl/research/memory-laws-in-european-and-comparative-perspectives/) and to strengthen the research capacity regarding human rights and anti-discrimination law in the Research Strand on ‘human dignity and security in international and European law’ and in the context of the Strategic Research Agenda (http://www.asser.nl/research).

Research

As an early-career researcher, you are expected to:

  • initiate, develop and execute high-level research independently in the context of the MELA project (www.melaproject.org);
  • assist in the organization of the major research and dissemination events for the MELA project envisaged for the academic year 2018-2019;
  • edit a special journal issue of the MELA project and assist with other publications of the Asser-based MELA team;
  • publish research articles about memory laws in peer-reviewed journals or edited books with leading publishers;
  • contribute to the weekly mentorship of a PhD researcher at the Institute;
  • participate in international seminars and conferences, be willing to travel and submit conference proposals;
  • initiate, contribute to, and participate in commissioned research projects and their acquisition;
  • draw reports on MELA execution for the grant authority;
  • regularly update the website and social media of the MELA project, as well as to initiate and actively extend media exposure of the MELA project;
  • have an active interest in other work of the research group (in particular, within Institute’s strand A) and contribute with research and/or execution of projects on anti-discrimination law and human rights.

Criteria

  • a completed PhD dissertation in European, international, or comparative constitutional law or human rights;
  • a demonstrated research focus on freedom of speech and/or anti-discrimination law and/or memory politics;
  • a research interest in legal governance of historical memory is a plus (for example, in memory politics, regulation of genocide denialism, historical memory and constitutional law, rule of law and history, a parallel degree in history or genocide studies, etc.);
  • knowledge of EU anti-discrimination law is an advantage;
  • fluency in two European languages or Hebrew, whereas fluency in Dutch is an advantage;
  • strong academic English is a must, native speakers are particularly welcome to apply;
  • a demonstrated track record of academic publications;
  • experience in organizing conferences and editing academic papers is an advantage;
  • experience with social media and website maintenance is an advantage;
  • a relevant academic, institutional (especially in Brussels) or media network;
  • enthusiasm about contributing to a stimulating research community and demonstrable communication skills;
  • willingness to compete in attracting external funding for research projects.

Conditions

  • The appointment is for one academic year (September 2018 – August 2019). Extension of the appointment is subject to the availability of extra funds and to satisfactory performance during the first year.
  • UFO Salary scale: 10-11 according to the collective labour agreement of the Dutch Universities (VSNU). Remuneration depends on the actual level of education, experience and knowledge with a maximum of €4.757- gross per month based on a full time equivalent (38 hours). Secondary benefits at Dutch universities are attractive and include 8% holiday allowance and an 8.3% year-end allowance.

Mr. Namit Saxena is an advocate practising at the Supreme Court of India. He is also one of the practising Comapany Secretary. He specialises in Fundamental Rights, Criminal law, White Collar Crime and Cyber Frauds. He is working with Mr. Ranjit Kumar (Solicitor General of India) as an Associate.

 

He has represented and appeared in Constitution Benches in Mohd. Arif v. UOI and Madras Bar Association case. He has also appeared in various other cases including Sahara v SEBI, Vodafone Transfer Pricing Judgement in Bombay High Court & Sanofi transfer pricing dispute. He has also drafted opinions on Interpretation on Para 19 of DPCO for reduction in Drug Control Prices, Tax and Financial Implications of extension of Product Sharing Contract.

YES! i am the CHANGE, 101-Hour Social Filmmaking Challenge 2016” (“Project”), is a nationwide film competition (“Competition”) where Participant/s (hereunder defined) make short films/ movies/videos on social cause/s and/or act of kindness (“Film/s”) and submit the same to the organisers of the Project, being YES FOUNDATION, a public charitable trust formed and registered in Delhi (“the Foundation”). The Foundation shall shortlist the Film/s and the winning Participant/s shall be awarded a filmmaking grant by the Foundation (“Award”).
However, the Award shall be used only for the purpose of filmmaking, which film, shall have to be made within 3 months from the announcement of the Award (“Award Film”) and the topic for the Award Film shall be assigned by the Foundation. These terms and conditions of entry, including information on how to enter and Award terms/details, together with the rules mentioned herein and on the Project website (collectively the “Terms”) apply to the Competition and form an agreement between the Foundation and the Participant/s. Submitting a Film/s as an entry for judging by the Foundation as part of the Competition is deemed to be an unequivocal acceptance of the Terms. ABOUT THE PUBLIC LAW TEAM

The Public Law vertical focuses on issues of constitutional law, administrative law and allied issues in public policy. The vertical works on engaged projects with Government Ministries and Commissions, providing research and drafting support at various stages of law-making. The vertical also conducts and freely disseminates independent research in areas of legal reform which it believes is critical to India’s future. The chief output from this vertical is in the form of research reports and draft legislation and regulation.

ROLE DESCRIPTION

The Senior Resident Fellow/ Research Fellow will work as an integral part of Vidhi and will be required to undertake research, analysis and legislative drafting for projects undertaken by the Public Law vertical.

About the University:​
South Asian University (SAU) is an international university established in New Delhi, India by the eight member nations of South Asian Association for Regional Co-operation (SAARC) viz. About The Faculty of Legal Studies:

The study of law at South Asian University aims at an analytical understanding of the subjects, systems, theories and institutions in this field. Towards this end, the Faculty of Legal Studies has introduced the LL.M Programme with an emphasis on international law. It is widely known that international law has become the common language of relations between states and other subjects. Keeping this in view, the Programme is sensitive to the perspective of South Asian countries. It is believed that the countries of the South Asian region would be able to explore new areas of cooperation if the study of their common legal problems is pursued with greater commitment. To be able to build a strong foundation for future research abilities of students in the region, the Faculty focuses on some important areas of international law as part of the LL.M and M.Phil/Ph.D. course structure.

Among the courses offered by the Faculty are: General Principles of International Law, International Trade Law, Law of International Organisations, International Human Rights Law, International Humanitarian, International Criminal Law, Law of the Sea, Private International Law, Intellectual Property Law, and Legal Theory and Jurisprudence. The Faculty equally emphasises on developing an interdisciplinary approach to the study of law in general and international law in particular. Further, the Faculty offers some innovative courses such as Comparative Constitutional Law of South Asian countries.

Apart from traditional pedagogic methods of teaching, the Faculty adopts seminar methods, wherein weekly legal discourses are organised. Eminent law scholars from India and abroad are invited to interact with faculty and students. The Faculty also organizes discussions on contemporary legal problems, through joint seminars with other institutions. Further, the Faculty intends to engage the available human resources in the region and other parts of the world to contribute towards establishing centres of excellence in the field of international law and other important fields of law.

About Master of Laws (LL.M) Programme

LLM is a two-year (four semesters) academic programme.

Minimum Eligibility Criteria
A minimum of 17 years’ education (12 years’ schooling + 5 years integrated BA/LLB degree with 50% marks) is the minimum prescribed eligibility. Candidates who have done 12 years’ schooling + 3 year Bachelor’s degree + 3 years’ LLB degree or 12 years’ schooling and 4 years’ LLB degree with 50% marks are also eligible.

About M.Phil./Ph.D. (Legal Studies)

Minimum Eligibility Criteria
12 years’ schooling + 5 year integrated BA/ LLB programme or 3 year Bachelor’s degree followed by 3 year LLB programme + 2 year LLM programme with 50% marks. Those who have done LLB followed by one-year LLM degree with the prescribed 50% marks are also eligible.
