About the Conference

The conference’s subject is “Custom and International Investment law”. The connection between customary international law (CIL) and international investment law has never been more pronounced. Despite this, several areas and topics that highlight this inter-connection remain woefully under analyzed and consistently overlooked. The present conference aims at addressing this Lacuna. The event will bring together leading academics, international judges/arbitrators and other practitioners, to discuss the most pertinent issues relating to the interaction between CIL and the International Investment Law, both from a theoretical and a practical perspective.

Call for Papers

The Organizing Committee of the conference “Custom and International Investment Law” is pleased to invite to the Conference, which will hold six thematic panels, an expert round-table and feature several keynote speakers (with invited experts and speakers, inter alia a former judge of International Court of Arbitrators). Scholars and practitioners interested in presenting during the Conference are encouraged to send their proposals. In selecting speakers, the Organizing Committee will consider the quality of the proposed papers. Each paper will be double-blind peer reviewed. Also, the speakers are requested to submit their paper before the conference (deadline 1st September 2020). Submitting the papers on that date is a precondition in order to be considered for the prepared publication. Authors of papers , which will be selected for publications, will be given time (until 1st November) to prepare the final version of their article/ chapter.

Within this framework, six main thematic issues will be discussed. Therefore, we invite submission of proposals engaging with any aspect that falls under the purview of these thematic issues as a dimension of the overarching theme of the conference. The organizers welcome proposals addressing one of the following issues, which set out exemplary but not exhaustive questions that may be addressed in the presentation and paper.

Thematic Issues

Thematic Issue 1: Importance and Evolution of CIL in International Investment Law. How has the evolution of international investment law affected our understanding of CIL? How and to what extent does CIL remain relevant for the contemporary problems with which
international investment law is faced? What can we learn from the practice of the mixed claims commissions (Mexico/Venezuela, Versailles Treaty commissions, etc.) regarding the emergence and development of customary rules of investment law? How did/do 19th and 20th century customary investment law rules (or the fact of their absence) influence or impact the
emergence of the present-day ISDS and investment treaty regime? How would the investment regime look like today if at certain points in time a customary rule (e.g.: NIEO) had emerged, while in fact it didn’t (counter-factual thinking)?

Thematic Issue 2: Interpretation of CIL in International Investment Law. Despite the importance of CIL in International Investment Law, both as primary and secondary rules, an area that has been relatively untouched has been that of interpretation of CIL. Investment tribunals do not merely identify the content of CIL rules through the classical doctrine of
State practice and opinio juris, but quite often achieve this content-determination through a process of interpretation that resembles quite closely that of treaty interpretation. The point of this thematic issue will be to explore this method of content-determination of CIL, and investigate the interpretative practices of CIL that are characteristic of International
Investment Law. For instance, are we dealing with rules of interpretation, or just merely principles of logic, when we discuss interpretation of CIL in international investment law? How similar are these rules/principles to treaty interpretation (i.e. do we use teleological, systemic, or other methods known in treaty interpretation)? Have the rules of interpretation themselves been interpreted by investment tribunals?

Thematic Issue 3: State Responsibility and Wrongfulness in International Investment Law. Within this thematic issue, the relevant issues are how the customary rules on State responsibility are applied in international investment law. Several sub-sets of rules on State responsibility raise intriguing questions within the scope of international investment law,
circumstances precluding wrongfulness, most notably countermeasures and state of necessity, being the most prominent of these. How do investment arbitration tribunals apply and interpret the customary rules of state responsibility? How do domestic courts, ruling on challenges to investment arbitration awards, apply and interpret the customary rules of state responsibility? Is there a noticeable difference between the practice of arbitral tribunals and domestic courts? Do arbitral tribunals/domestic courts follow and ICJ practice and the ILC commentary or do they significantly deviate from them? If so, do they do so across the board
or only regarding specific rules and specific topics? Has there been a change in the practice since the adoption of the 2001 ILC Articles?

Thematic Issue 4: State Responsibility and Compensation. Despite the fact that state responsibility and standards of compensation are a critical issue in contemporary investment arbitration there is still a great degree of uncertainty surrounding these topics. This is further exacerbated by the fact that a clear understanding of their normative status and interplay is crucial not only to the adopted litigation strategy, but also to the decision of whether to pursue litigation of a dispute at all. Within this thematic issue, we aim to examine a number of critical issues. Should the standards of compensation be perceived as reflecting CIL? Are the established methods of valuation, if any, norms of CIL? How do courts arrive at these standards, through an evaluation of state practice and opinio juris or through an interpretative exercise of a more general pre-existing CIL rule? Given the criticism of PCIJ and ICJ judgments on investment law (see, for instance, the debate on whether the PCIJ really applied CIL in the Chorzów Factory case) what is truly the content of the contemporary principles for damages and compensation that stem from CIL? In sum, which of the following are the methods that are applied in investment law? Are they an assertion, an application or an interpretation of existing CIL rules? Or are they perhaps something entirely new and beyond custom or even beyond law?

Thematic Issue 5: CIL and Execution and Annulment Proceedings Before Domestic Courts. The role of CIL in execution and annulment proceedings in domestic courts is the focal point of this thematic issue. Examining the practice of national courts and regional or country specific differences with respect to their approach to CIL and investment law will yield interesting results. For example, how do domestic courts interpret and apply CIL in execution and annulment proceedings? What different patterns exist and what are the reasons for such divergences (or convergences) of the national approaches? What is the approach of domestic courts to the elements of custom under international law? Are there differences discernible with regard to specific issue areas or with regard to specific countries?

Thematic Issue 6: TWAIL, CIL and International Investment Law. The questions to be asked within this thematic issue are: What lessons that can be learned from the Third World Approaches to International Law (TWAIL), e.g. which customary norms derive from the times of gunboat diplomacy and how has their continued relevance shaped the investment regime as it stands today? What are the regional differences regarding their approach to CIL and what can we learn from the diverse practice of various continents (in opposition to the Western-centric prevailing attitude)? For example, is there a regional Latin American CIL of relevance for international investment law and arbitration?

Publication

A selected number of papers presented during the Conference are intended to be included in an edited volume published by a renowned Publisher. To be considered for the planned publication the participants should send their paper (or at least a very advanced draft thereof) to the organizers before or on 1st September 2020. Selected applicants whose contributions
will be included in the book will be informed shortly after the end of the Conference, and should send their final version of the chapter no later than 1st November 2020. More information will be provided in due course.
Should the quality and interest in publication in the edited volume exceed the capacity of an edited volume, the option will be offered to publish some of the papers that will not feature in the book in a special issue on Investment and Custom in a well-respected international law journal.

Taught by one of the world’s leading experts in the field, this course will educate students about the fundamentals of international criminal law and policy. We will explore the contours of international crimes such as genocide, war crimes, terrorism, and piracy. We will examine unique modes of international criminal liability and specialized defenses. And we will delve into the challenges of obtaining custody of the accused and maintaining control of the courtroom.

Course Format

This course is made up of eight content units. Each unit is based on an online reading assignment, a video lecture of about one hour in length, and one or more role play exercises to stimulate on-line discussion. The course also offers in-video enrichment quizzes (ungraded) for each unit, a ten question multiple choice midterm diagnostics exam (ungraded), and a ten question True/False Final Exam.

Human rights develop through the constant dialogue between international human rights bodies and domestic courts, in a search that crosses geographical, cultural and legal boundaries. The result is a unique human rights grammar, which this course shall discuss and question, examining the sources of human rights, the rights of individuals and the duties of States, and the mechanisms of protection. “For the internet to remain global and open, it is imperative that countries, including those currently lacking capacity to adequately deal with security concerns, to adopt a growth- and freedom-oriented, participative, bottom-up perspective on security that has human rights at its core.” (Joint Governmental Statement at UN Human Rights Council in June 2013)

Arguably, the internet poses severe challenges to state sovereignty and governmental legitimacy. Governments around the world find it increasingly difficult to control, regulate or monitor the massive flow of data within the cyber-world and uphold human rights and fundamental freedoms at the same time. Nevertheless, the world wide web is one of the main prerequisites for economic growth and democracy. It enables citizen participation , engagements and inter-action on all levels that can lead to social transformation and political change. Radical groups, democracy movements, development organizations and human rights NGOs all use the internet to further their goals.

Since the former NSA contractor, Edward Snowden, released a variety of confidential documents we all know of PRISM, TEMPORA and other programs and their massive privacy infringements. These programs were primarily designed to collect user data to increase the capability of intelligence services to protect societies from internal and external threats. But are those programs not undermining essential citizen freedoms and fundamental human rights?

This course systematically examines the compliance between international human rights norms, standards and mechanism within legal and political frameworks and the growing cyber security regime. Debates about the loss of state sovereignty over cyber security, paired with the idea of internet freedom and users’ and citizens’ responsibility lead to the question, whether individual and state responsibility based on reciprocity and human rights compliance are reconcilable.

Learning Outcomes
Students taking this course will learn:
• how human rights are used in the debate about Public Privacy
• how individual, societal, political and governmental actors interact in this context
• what cyber security in consistency with human rights is about.

Using this information, students will practice assessing and analyzing cyber security issues based on international human rights norms, standards and regimes.

About this course

This course is designed as a vocabulary of the main terms used by all of us when talking about local as well as world politics; terms which we often use without a proper awareness of their meanings and connections, a circumstance not exactly helpful to any attempt at understanding how politics really works, regardless of our wishful thinking or simplistic morality or easy cynicism.

Course Structure

Now, if we want to get deeper into the workings of politics – the only serious starting point for those who want to reform it – we must agree to begin with very abstract notions, that is with the general definitions of what politics, conflict, power (incl. force/violence), and what legitimate power mean (Part 1: What is Politics?). On these premises we will then explain the still main political institution, the state, and peer into the dynamics of war and peace that has dominated the relationships between the states (Part 2: How Does Politics Work?). Since with economic globalization, which has restricted the room for political action, things are getting much more complicated on the planet, and more challenging outside of it (man-made climate change starts in the atmosphere), classical notions have to be rethought. The very nature of the threats endangering our global commons does not leave the definition of politics (Part 3: World Politics and the Future).
This course does not aim at communicating any ‘message’ as to how politics ought to be, but it will obviously try to clarify the main concepts – freedom, equality, justice – we make use of while talking about values and principles in politics; this is what is called ‘normative political philosophy’ and is regarded here as an important chapter of political philosophy, not the whole of it (Part 4: Ethics and Politics).

Learning Outcomes

At the end of the course you may have achieved a clearer and less confused awareness of the political vocabulary, thus gaining a more complex, more autonomous and more critical understanding of political processes. If you are a student of political science, law, sociology and economics you may get better tools for catching the overarching sense of processes that you do otherwise approach in a fragmented perspective.

Workload

My teaching method aims primarily at defining and discussing concepts, not at illustrating authors or providing historical narratives; needless to say, there will be enough reference to authors, books, events and processes, in particular with regard to the evolution of political modernity. For each of the twelve lectures of about 30-40′, which will be presented in shorter units, you may need three more hours of homework to do additional readings and – more importantly – to perform additional reflection.

Course Format

For most of the notions discussed in the course I will suggest readings consisting of both classical authors and recent literature. For each lecture I will reply to up to five requests of clarification or critical assessments (all this exclusively via the iversity platform). From time to time you will have the opportunity to test your acquisition of fresh knowledge by responding to multiple-choice-tests. At the end of the course you may want to take a final exam, whose format will be announced later. Letter-grading from 1 to 5 will be used.
There will be unfortunately no textbook. The textbooks available in English are all, though in various ways, different from my approach and my contents. My slides will serve as a textbook in a nutshell.

Prior Knowledge

Due to my conceptual approach, to follow this course you do not need a prior knowledge of philosophy or political science, just the degree of general culture needed to pass the final high school exam, be it Abitur, maturità, baccalauréat or 高考(gao kao).

In 2012, the EU received the Nobel Peace Prize for its decades-long contribution to the advancement of peace and reconciliation, democracy and human rights in Europe. War has become virtually unthinkable in the EU. When the first steps towards supranational cooperation – primarily targeted at preventing the rearmament of Germany – were made in the aftermath of World War Two, the Founding Fathers of the European integration construct could never have imagined this outcome in their wildest dreams. Over the years, the supranational cooperation would widen – from the original European Communities consisting of 6 Member States to the current Union of 27 Members – and deepen – from the originally almost purely economically inspired Communities to the current Union with a say in almost all areas of national competence. At the same time, problems with the Euro have plunged the EU in one of the biggest crises since its inception. This challenges lawmakers to tackle difficult questions about the continued existence of the Euro and the future direction of the European integration project.

This course will give the students an insight into the law of the EU, a vast and fascinating area of law which forms an integral part of the legal systems of its 27 Member States. The course is divided into three parts. In the first part, we will pay attention to the creation and the development of the EU, its institutional structure and functioning, and the specific nature and sources of EU law. In the second part, we will examine how EU law impacts on the lives of EU citizens as well as on companies that are established or provide services in the EU. In the final part, we will tackle Europe’s common currency crisis, investigating causes, effects and possible routes out of this existential crisis of the Union.

About the Course

From the Nuremberg trial to the case against Saddam Hussein, from the prosecution of Al-Qaeda terrorists to the trial of Somali pirates – no area of law is as important to world peace and security as international criminal law. Taught by one of the world’s leading experts in the field, this course will educate students about the fundamentals of international criminal law and policy. We will explore the contours of international crimes such as genocide, war crimes, terrorism, and piracy. We will examine unique modes of international criminal liability and specialized defenses. And we will delve into the challenges of obtaining custody of the accused and maintaining control of the courtroom.
Course Syllabus

This course comprises eight units. Each will include an assigned reading, typically an article or book chapter, as well as a simulation designed to bring the readings to life.

I will offer video discussions of each of the topics, accompanied by slides. In addition, there will be online role-play exercises and debates, enabling the students to share their own insights.

The order of class sessions will be:

(1) History: From Nuremberg to The Hague

(2) International Crimes Part 1: War Crimes and Crimes Against Humanity

(3) International Crimes Part 2: Terrorism and Piracy

(4) Special modes of liability: command responsibility and co-perpetration

(5) Special defenses: obedience to orders, duress, and necessity

(6) Gaining custody of the accused: extradition, luring, and abduction

(7) Pre-Trial Issues: plea bargaining and exclusion of torture evidence

(8) Maintaining control of the courtroom
Recommended Background

You don’t have to be a lawyer and there are no prerequisites for this course. However, the course will be conducted at the level expected of advanced undergraduate students. Therefore, for all participants, reading and writing comfortably in English at the undergraduate college level is desirable.

Students should review the assigned online readings for each unit in advance of the class session.
Course Format

This course is made up of eight content units. Each unit is based on an online reading assignment and simulation. Students are given the opportunity to comment online on the reading material and simulation. Each content unit includes video clips and slides, totaling about one hour, drawing from the unit’s reading. The course also offers an enrichment quiz (ungraded) for each unit and an on-going forum for participant discussion. That forum will be monitored and may stimulate the creation of a supplementary clip or two per unit.
