Human rights are a complex issue. Their protection and promotion involve a number of actors: from international organisations to local communities, from governments to civil society. Human rights affect all aspects of our life, as individuals (as women, men, children, refugees, workers…) and as members of a community. This MOOC provides students with critical knowledge concerning the norms, institutions and procedures tasked to promote and protect human rights. Students will acquire the knowledge needed to actively join the global debate on fundamental rights and to avail themselves of the existing legal and institutional tools set up for their implementation. The MOOC introduces to the human rights legal framework in a multi-disciplinary and multi-level perspective, helping students to approach real-life scenarios with competence and cultural and ethical awareness.

What do I learn?

Students are expected to acquire a sound knowledge of the international system of human rights protection, and of the opportunities for human rights promotion and protection that are practically available at the national and local levels. The skills acquired can be preparatory for further specialisation on this subject. Finally, students will be able to apply the acquired knowledge and skills to real scenarios, including in relation to their everyday life.

What do I need to know?

The MOOC is mainly addressed to people from all over the world who have a background in political science, international relations and/or international law. The course, however, includes a general introductory chapter explaining the main issues, concepts and scenarios at stake. For this reason the MOOC is also open to people actively engaged on the ground that do not have a specific academic or educational background.

Course Structure

Chapter 1 – The basics The Chapter aims to introduce the course and starts addressing (and providing some preliminary answers) some basic questions: What are human rights? Who is involved in their protection? Why are human rights a global priority? How can effectively be protected? Chapter 2 – The UN and human rights The focus is on the evolution of the UN commitment in human rights protection based on three pillars: positivisation, monitoring and mainstreaming. Chapter 3 – The UN human rights machinery The analysis deals with the UN mechanisms for the protection of human rights at the global level. Special attention will be given to the role of the Human Rights Council and the Universal Periodic Review. Chapter 4 – The European system for the promotion and protection of human rights The Chapter starts looking into the promotion and protection of human rights at regional (continental or sub-continental) levels. In particular, the European system will be presented highlighting the respective roles of the European Union, the Council of Europe, and the OSCE and their capacity to interplay and possibly complement each other. Chapter 5 – Regional systems for the promotion and protection of human rights in Africa, Asia and the Americas The other regional systems investigated in this chapter are those operating in the framework of regional organisations in the Americas (the Organisation of American States), in Africa (the African Union), in the Arab world (the League of Arab States), as well as in South-East Asia (the ASEAN). Chapter 6 – Human rights in conflict and post-conflict contexts The focus shifts to the national level, in particular to situations of armed conflict and to post-conflict scenarios. Issues related to the standards and procedures of International Humanitarian Law and International Criminal Law are also tackled. Chapter 7 – Human rights promotion and protection at the National and sub-national level This Chapter addresses a number of issues related to the role of National Human Rights Institutions and other actors involved in human rights policies nationwide and at the local/community levels, such as local governments and municipalities. Chapter 8 – The driving forces of human rights promotion: the role of civil society The Chapter focuses on civil society organisations and networks. The analysis looks into the multifaceted strategies carried out by non-state actors, especially in relation to the international instances of human rights protection. Chapter 9 – Conclusions: perspectives on global human rights A summary and discussion of the multi-level dimensions of human rights protection dealt with in the previous chapters. This final segment provides some closing critical reflections on the questions set forth in Chapter 1. Mid –term homework At the end of chapter 4, the instructions for homework will be released: homework must be submitted by the end of chapter 6 (2 weeks). Homework consists of writing a communication or a petition addressed to one of the monitoring bodies studied in the first four chapters. The aim is to familiarise students with the tools of human rights protection mechanisms. The texts will be evaluated using a peer review methodology. Final homework At the end of chapter 8, the instructions for homework will be released: homework must be submitted in 2 weeks. Students will be asked to write, using a simplified form, a project addressing a human rights related issue that is challenging their town, territory, home country and likely to be taken up by governmental or non-governmental agencies. Within each chapter, the MOOC offers tailored case-studies, interviews with field experts, officers and academics.

This chapter introduces the concept of Global Workers’ Rights and explains the history and functioning of the International Labour Organization (ILO) as the organization setting International Labour Standards (ILS). The prospects and challenges of the ILO approach to Global Workers’ Rights are debated, and you will learn about the mainstream economic arguments against ILS and how to assess them critically.

Chapter 2: Introduction to International Labour Standards (ILS)

Which types of International Labour Standards exist and how are they set? Which actors are involved and how are they interlinked? This chapter provides an overview on International Labour Standards and lays the foundation for understanding the standard setting mechanisms at the ILO. The role of trade unions in this process is illustrated through a concrete example of a recent and ground-breaking Convention for one of the most vulnerable groups of workers.

Property is where law and economics meet, but it’s not a simple concept. Property is not an object or a relation between people and objects, but a set of rights, relations among people over who is to control each of the many uses to which objects can be put. Different people may control different uses of an object, that is, have different property rights over its various uses, at the same time, or control the same use of the object at different times. When new uses create disputes, the law must define new property rights and allocate them initially to resolve the dispute – someone must be deemed to have won the dispute and be given initial ownership of the new rights. But once the former disputants are allowed to trade these rights among themselves, surprising results follow.

Voluntary exchange implies mutual benefit – when people trade property rights, it’s because they each believe that what they get from the trade will be more valuable to them than what they have to give up to get it. So if there are no obstacles to voluntary exchange, that is, if transaction costs are low, property rights will end up in the hands of the person who values them the most, a result economists call an efficient allocation of the rights. What happens when there are barriers that impede or prevent property rights from reaching their highest valuing owner through exchange? Can the law assign property rights to achieve efficient allocation in such cases? Should it try, or are there values other than efficient allocation the law might try to advance, along with or instead of efficient allocation, in assigning property rights?

Exchange involves both benefit and cost – traders take rights from others, imposing costs on them but creating benefit for themselves, but they must compensate the others for their costs by paying for the rights they’ve taken. External costs are imposed when one person takes another’s rights without paying for them, which leads to the taker taking more rights than efficient allocation would allow and leaves the victim uncompensated for the costs of losing the rights. The law’s response to this inefficiency and injustice is liability, forcing those who take rights without payment to compensate those whose rights they have taken for the costs they have borne. Thinking about how the law determines these liability prices, and how people might respond to them, reveals the underlying economic logic of liability.

4. Crime and Punishment
Some externalities involve only a few uncompensated losers of rights whose costs are easily reckoned in monetary terms, so that forcing the taker to pay exactly these costs to the victims ensures both that victims will be fairly compensated and that takers will take rights only where they value the rights more than the losers do. The law calls these externalities torts, and the same principle of liability pricing extends to crimes, in which, with the same unlawful act, someone simultaneously takes the rights of many people who suffer moral costs that can’t be satisfactorily measured by money. As with torts, some crimes may be efficient reallocations of rights, and the logic of liability shows that proportional punishment can, ideally, discover which crimes are or are not efficient and force all takers to compensate their victims in full for what they take.

5. Property, Utility and Technology
The concept of property is developed in two new directions. One concerns the problem of eminent domain and evokes the ancient conflict between individual rights and collective needs – in what circumstances, and to what extent, should private property be protected against uncompensated taking by government? How do the different theories of property considered earlier each answer this question? The other asks how voluntary exchange can be organized when technology makes it easy for people to take others’ property rights without compensation. If existing rights are insufficient to prevent these takings from occurring on a large enough scale to make voluntary exchange impossible, new kinds of property rights are needed to encourage efficient levels of production and exchange. This is illustrated by the problem of intellectual goods and the new forms of property that have evolved over centuries to make exchange in ideas possible.

6. Criminal Procedure
Criminal liability means that crimes have prices, and how these prices are exacted in practice from people who take rights without compensation is the problem of criminal procedure. How do judges know who is guilty, and what prices guilty people should be made to pay for their crimes? Around the world, two major systems of adjudicating guilt and punishment, the adversarial and the inquisitorial, have evolved over centuries to answer these questions in individual cases, with very different procedures to assess guilt and punishment that express different commitments to truth and fairness. All these procedures are expensive, and governments everywhere must confront the problem of processing large caseloads with limited resources. This has led the inquisitorial systems of Europe and the adversarial systems of England and the United States to new procedures of adjudication that may be reducing the differences between them.

This course is designed to outline key features of policy advice and political consulting and their impact on governance.
We will observe the key players on the spot as well as those behind the scenes and we will analyze their patterns of interaction. Moreover, we will provide insights regarding essential questions to which there are no single right answers: What role does policy advice play in different democracies? What is good policy advice? What makes an expert? In sum: Whom do (and should) politicians and society listen to, and what do (and should) they make of the advice they receive?

What do I learn?

By the end of the course, students will know the key concepts of policy advice as well as the main actors in the field and their patterns of interaction. They will understand how and by whom a certain political decision is framed, shaped and implemented. And they will be able to apply this knowledge to a given political event which may affect their own professional or personal life. About this course

Course Summary

This course is designed as a vocabulary of the main terms used by all of us when talking about local as well as world politics; terms which we often use without a proper awareness of their meanings and connections, a circumstance not exactly helpful to any attempt at understanding how politics really works, regardless of our wishful thinking or simplistic morality or easy cynicism.

Now, if we want to get deeper into the workings of politics – the only serious starting point for those who want to reform it – we must agree to begin with very abstract notions, that is with the general definitions of what politics, conflict, power (incl. force/violence), and what legitimate power mean (Part 1: What is Politics?). On these premises we will then explain the still main political institution, the state, and peer into the dynamics of war and peace that has dominated the relationships between the states (Part 2: How Does Politics Work?). Since with economic globalization, which has restricted the room for political action, things are getting much more complicated on the planet, and more challenging outside of it (man-made climate change starts in the atmosphere), classical notions have to be rethought. The very nature of the threats endangering our global commons does not leave the definition of politics (Part 3: World Politics and the Future).
This course does not aim at communicating any ‘message’ as to how politics ought to be, but it will obviously try to clarify the main concepts – freedom, equality, justice – we make use of while talking about values and principles in politics; this is what is called ‘normative political philosophy’ and is regarded here as an important chapter of political philosophy, not the whole of it (Part 4: Ethics and Politics).

What will I learn?

At the end of the course you may have achieved a clearer and less confused awareness of the political vocabulary, thus gaining a more complex, more autonomous and more critical understanding of political processes. If you are a student of political science, law, sociology and economics you may get better tools for catching the overarching sense of processes that you do otherwise approach in a fragmented perspective.

Due to my conceptual approach, to follow this course you do not need a prior knowledge of philosophy or political science, just the degree of general culture needed to pass the final high school exam, be it Abitur, maturità, baccalauréat or 高考(gao kao).

CopyrightX 2015 Online course by Harvard

CopyrightX is a networked course that explores the current law of copyright; the impact of that law on art, entertainment, and industry; and the ongoing debates concerning how the law should be reformed. Through a combination of recorded lectures, assigned readings, weekly seminars, live interactive webcasts, and online discussions, participants in the course examine and assess the ways in which the copyright system seeks to stimulate and regulate creative expression.

In 2013, HarvardX, Harvard Law School, and the Berkman Center for Internet & Society launched an experiment in distance education- CopyrightX, the first free and open distance learning course on law. After two successful offerings, CopyrightX is an experiment no longer. Under the leadership of Professor William Fisher, who created and directs the course, CopyrightX will be offered for a third time from January to May 2015.

Three types of courses make up the CopyrightX Community:

  • a residential course on Copyright Law, taught by Prof. Fisher to approximately 100 Harvard Law School students;

About the Course

The idea of drafting an agreement with a given template or term sheet and turning it into the execution copy, is not as easy as it seems. There are several ingredients which goes into the raw term sheet or template before the final recipe is ready to be served to the client. Some of the most important ingredients which you would be needing here are, your knowledge and understanding of the subject, experience, foresight of an eagle and above all, how a Court or an Arbitrator is going to interpret those terms, in case the contract ends up in the Court room desk of a Judge or an Arbitrator. To avoid any protracted litigation and consequent loss of one’s reputation, a smart lawyer would never draft a contract with loose ends, i.e. a contract which may be subject to several interpretations, in particular the one which may prejudice the interest of his/her client.

This course explores the rules for interpretation of contracts which the Courts and Arbitration Tribunals in India and common law countries often use to read and interpret the terms of a contract. The Course intends to help you develop an understanding of the interpretative value of different terms of a contract, so that you can use them as backdrop while you are drafting an agreement. This can help you sharpen your drafting skills and avoid any messy situation leading to loss of your reputation as a lawyer. 1. What is the area of work you are presently working in sir ?

I am presently practicing in High Court, Delhi and also rendering my services as a legal consultant to a commission.

2.How do you assess your college days as a help to your career?

I miss every single second spend in the college. I was lucky enough that I learnt a lot during my college life by participating in various competitions. Of course all the exposure I had during college helped me a lot to improve my speaking and writing skills.

3.Any memorable moment you would share with us, which is related to your academic success? Any prize which you remember winning had a great importance to you?

All the days spent in RGNUL are really memorable to me because I learnt a lot during my college life. When I entered law school,I was the one who had nothing to write in CV except 10th and 12th marks. From that day I started working and today I feel happy that I have lot of good memories of RGNUL in my CV which will remain with me forever.
One Prize I would like to mention here is Manupatra best researcher award which I won during my 1st year of law school which made me realize that I can do something on my own and then I never looked back.

4.Can you please share with us a few awards and prizes which you have won on your journey to success?

For many, negative thinking is a habit, which over time, becomes an addiction. A lot of people suffer from this disease because negative thinking is addictive to each of the BIG Three–The Mind, The Body, and the Emotions. If one doesn’t get you, the others are waiting in the wings.

I always consider myself as a student of law who is always willing to learn…..because learning never stops in life. Also, if you stop learning you close the doors of success.

6.What are you planning to do further and where do you want yourself to be seen in coming years?

I have developed a great interest in writing during college days. After I graduated from RGNUL I devoted most of my time to writing and the result is that I have to my credit the achievement of publishing the maximum no. of books on law in a year (http://www.miraclesworldrecords.com/Gallery/Details/170 I am preparing myself for public prosecutor exam in future and preparing myself to fulfill my dream of writing a Commentary on Constitution Law.

RGNUL STUDENTS BRING HOPE FOR THE NEEDY

Breaking the familiar stereotype that, these days people enter the field of law just to make money, students of Rajiv Gandhi National Law University are on a drive to teach the kids of the poor and needy. Every evening some dedicated students of the premier law institute, strive hard to brighten the dark world of the little kids who are deprived of even the basic necessities of life. Started by a RGNUL graduate, this idea gained foothold in 2011, when a fundraiser event, in which woolens were donated to the poor children, focused public attention towards this undertaking. And since then, there has been no looking back. Juniors as well as seniors, whoever feels connected to the mission is welcome to be a part of the group.

 

The college authorities have also been very supportive in this noble endeavor of the students and have donated books and stationery for that purpose. The parents of these little kids, who are mostly laborers by profession, are also quite enthusiastic about the whole exercise. They cannot afford to send their children to the school but they do want their children to get educated. And the students of RGNUL are no less than saviors for them who have dedicated themselves to teach their kids and that too free of cost. The volunteers are also aiming to get the children enrolled into a government school in Sidhuwal village where the college is located. And not just this, in October 2013, a cultural programme was also organized by the students to add color to the otherwise monotonous lives of the children who live in the confines of small huts, looking after their younger siblings. The students not only organized the event on the lines of a Halloween party but also helped the students prepare their music and dance acts. And at the end of it, a pizza feast for all was a wonderful surprise. This dedicated effort to bring smiles on the faces of those little neglected children, by the students of RGNUL is truly praiseworthy. And not risking complacence, the students are constantly striving to learn newer and better ways of imparting knowledge especially by making it more colorful and interesting, like letting the kids watch cartoons on the projector in between study sessions to break the classroom tedium.

This endeavor of RGNUL students is only a drop in the ocean, but the ripple effect of this drop is far reaching. And commendable is their spirit and devotion for the job that they manage to take out time from their busy schedules which is specifically tough in a law school. But what really keeps them going is the satisfaction and mental peace that they get when they color the imagination of some innocent minds who had only witnessed the gray shades of life until now. Not to forget the hope they instill in the hearts of their parents who are now much more optimistic about their child’s future. It is indeed an admirable effort by the group that includes- Ashwini Reddy, Kopal, Noby, Riya, Vipan, Anumeha, Vinita, Madhulika, Kiran, Neeraj, Arpna, Nikita, Chetali and many more.

The course will be conducted over a one month period and will include exhaustive modules, interactive sessions with experts and practical information on the use of Right to Information for social issues advocacy. About this course

This course is designed as a vocabulary of the main terms used by all of us when talking about local as well as world politics; terms which we often use without a proper awareness of their meanings and connections, a circumstance not exactly helpful to any attempt at understanding how politics really works, regardless of our wishful thinking or simplistic morality or easy cynicism.

Course Structure

Now, if we want to get deeper into the workings of politics – the only serious starting point for those who want to reform it – we must agree to begin with very abstract notions, that is with the general definitions of what politics, conflict, power (incl. force/violence), and what legitimate power mean (Part 1: What is Politics?). On these premises we will then explain the still main political institution, the state, and peer into the dynamics of war and peace that has dominated the relationships between the states (Part 2: How Does Politics Work?). Since with economic globalization, which has restricted the room for political action, things are getting much more complicated on the planet, and more challenging outside of it (man-made climate change starts in the atmosphere), classical notions have to be rethought. The very nature of the threats endangering our global commons does not leave the definition of politics (Part 3: World Politics and the Future).
This course does not aim at communicating any ‘message’ as to how politics ought to be, but it will obviously try to clarify the main concepts – freedom, equality, justice – we make use of while talking about values and principles in politics; this is what is called ‘normative political philosophy’ and is regarded here as an important chapter of political philosophy, not the whole of it (Part 4: Ethics and Politics).

Learning Outcomes

At the end of the course you may have achieved a clearer and less confused awareness of the political vocabulary, thus gaining a more complex, more autonomous and more critical understanding of political processes. If you are a student of political science, law, sociology and economics you may get better tools for catching the overarching sense of processes that you do otherwise approach in a fragmented perspective.

Workload

My teaching method aims primarily at defining and discussing concepts, not at illustrating authors or providing historical narratives; needless to say, there will be enough reference to authors, books, events and processes, in particular with regard to the evolution of political modernity. For each of the twelve lectures of about 30-40′, which will be presented in shorter units, you may need three more hours of homework to do additional readings and – more importantly – to perform additional reflection.

Course Format

For most of the notions discussed in the course I will suggest readings consisting of both classical authors and recent literature. For each lecture I will reply to up to five requests of clarification or critical assessments (all this exclusively via the iversity platform). From time to time you will have the opportunity to test your acquisition of fresh knowledge by responding to multiple-choice-tests. At the end of the course you may want to take a final exam, whose format will be announced later. Letter-grading from 1 to 5 will be used.
There will be unfortunately no textbook. The textbooks available in English are all, though in various ways, different from my approach and my contents. My slides will serve as a textbook in a nutshell.

Prior Knowledge

Due to my conceptual approach, to follow this course you do not need a prior knowledge of philosophy or political science, just the degree of general culture needed to pass the final high school exam, be it Abitur, maturità, baccalauréat or 高考(gao kao).

Course Description

“For the internet to remain global and open, it is imperative that countries, including those currently lacking capacity to adequately deal with security concerns, to adopt a growth- and freedom-oriented, participative, bottom-up perspective on security that has human rights at its core.” (Joint Governmental Statement at UN Human Rights Council in June 2013)

Arguably, the internet poses severe challenges to state sovereignty and governmental legitimacy. Governments around the world find it increasingly difficult to control, regulate or monitor the massive flow of data within the cyber-world and uphold human rights and fundamental freedoms at the same time. Nevertheless, the world wide web is one of the main prerequisites for economic growth and democracy. It enables citizen participation , engagements and inter-action on all levels that can lead to social transformation and political change. Radical groups, democracy movements, development organizations and human rights NGOs all use the internet to further their goals.

Since the former NSA contractor, Edward Snowden, released a variety of confidential documents we all know of PRISM, TEMPORA and other programs and their massive privacy infringements. These programs were primarily designed to collect user data to increase the capability of intelligence services to protect societies from internal and external threats. But are those programs not undermining essential citizen freedoms and fundamental human rights?

This course systematically examines the compliance between international human rights norms, standards and mechanism within legal and political frameworks and the growing cyber security regime. Debates about the loss of state sovereignty over cyber security, paired with the idea of internet freedom and users’ and citizens’ responsibility lead to the question, whether individual and state responsibility based on reciprocity and human rights compliance are reconcilable.

Learning Outcomes
Students taking this course will learn:
• how human rights are used in the debate about Public Privacy
• how individual, societal, political and governmental actors interact in this context
• what cyber security in consistency with human rights is about.

Using this information, students will practice assessing and analyzing cyber security issues based on international human rights norms, standards and regimes.

Course StructureThe first part of the course will provide an overview of the current state of international and regional human rights regimes and their efforts to protect freedom rights while also ensuring private security. The second part will then go into the evolution of human rights, their violations and protection mechanism in era of the internet.

Week 1: An introduction to public privacy, cyber security and human rights

Week 2: Yours and the rights of others: civic and social human rights

Week 3: Human rights cyber regime

Week 4: Agencies for the human rights cyber space

Week 5: Security, human rights and privacy assurance through Internet

Week 6: E-democracy and social networks

Week 7: Public versus State Sovereignty

Week 8: Public Privacy, internet freedom and state responsibility.

Course Format

The course will be hosted online and will consist of lectures by the instructor, as well as guest lectures and exclusive interviews with respective stakeholders. Additional reading material, animations and images will support each learning objective. Students will be assessed through quizzes, peer-to-peer review and their participation in interactive discussion forums.
