IP Assisto is a Centre committed to disseminating awareness and carrying out research in order to contribute towards building a robust Intellectual Property Rights (IPR) regime in India. IP Assisto is organizing a Training Program for members of the Pharmaceutical Industry. This Program is aimed at providing undergraduate students and young professionals holding degrees in or having passion for pharmacy, pharmaceutical sciences and related innovations with an opportunity to understand the intellectual property rights and related legal aspects with reference to technology and other innovations. It is intended to acquaint them with relevant IP laws in India and abroad, which are especially relevant to the changing scenario in the IPR domain in today’s epoch. It is also intended to help participants understand the benefits and cost of IP protection and its implications to the society at large.

About the Conference

The conference’s subject is “Custom and International Investment law”. The connection between customary international law (CIL) and international investment law has never been more pronounced. Despite this, several areas and topics that highlight this inter-connection remain woefully under analyzed and consistently overlooked. The present conference aims at addressing this Lacuna. The event will bring together leading academics, international judges/arbitrators and other practitioners, to discuss the most pertinent issues relating to the interaction between CIL and the International Investment Law, both from a theoretical and a practical perspective.

Call for Papers

The Organizing Committee of the conference “Custom and International Investment Law” is pleased to invite to the Conference, which will hold six thematic panels, an expert round-table and feature several keynote speakers (with invited experts and speakers, inter alia a former judge of International Court of Arbitrators). Scholars and practitioners interested in presenting during the Conference are encouraged to send their proposals. In selecting speakers, the Organizing Committee will consider the quality of the proposed papers. Each paper will be double-blind peer reviewed. Also, the speakers are requested to submit their paper before the conference (deadline 1st September 2020). Submitting the papers on that date is a precondition in order to be considered for the prepared publication. Authors of papers , which will be selected for publications, will be given time (until 1st November) to prepare the final version of their article/ chapter.

Within this framework, six main thematic issues will be discussed. Therefore, we invite submission of proposals engaging with any aspect that falls under the purview of these thematic issues as a dimension of the overarching theme of the conference. The organizers welcome proposals addressing one of the following issues, which set out exemplary but not exhaustive questions that may be addressed in the presentation and paper.

Thematic Issues

Thematic Issue 1: Importance and Evolution of CIL in International Investment Law. How has the evolution of international investment law affected our understanding of CIL? How and to what extent does CIL remain relevant for the contemporary problems with which
international investment law is faced? What can we learn from the practice of the mixed claims commissions (Mexico/Venezuela, Versailles Treaty commissions, etc.) regarding the emergence and development of customary rules of investment law? How did/do 19th and 20th century customary investment law rules (or the fact of their absence) influence or impact the
emergence of the present-day ISDS and investment treaty regime? How would the investment regime look like today if at certain points in time a customary rule (e.g.: NIEO) had emerged, while in fact it didn’t (counter-factual thinking)?

Thematic Issue 2: Interpretation of CIL in International Investment Law. Despite the importance of CIL in International Investment Law, both as primary and secondary rules, an area that has been relatively untouched has been that of interpretation of CIL. Investment tribunals do not merely identify the content of CIL rules through the classical doctrine of
State practice and opinio juris, but quite often achieve this content-determination through a process of interpretation that resembles quite closely that of treaty interpretation. The point of this thematic issue will be to explore this method of content-determination of CIL, and investigate the interpretative practices of CIL that are characteristic of International
Investment Law. For instance, are we dealing with rules of interpretation, or just merely principles of logic, when we discuss interpretation of CIL in international investment law? How similar are these rules/principles to treaty interpretation (i.e. do we use teleological, systemic, or other methods known in treaty interpretation)? Have the rules of interpretation themselves been interpreted by investment tribunals?

Thematic Issue 3: State Responsibility and Wrongfulness in International Investment Law. Within this thematic issue, the relevant issues are how the customary rules on State responsibility are applied in international investment law. Several sub-sets of rules on State responsibility raise intriguing questions within the scope of international investment law,
circumstances precluding wrongfulness, most notably countermeasures and state of necessity, being the most prominent of these. How do investment arbitration tribunals apply and interpret the customary rules of state responsibility? How do domestic courts, ruling on challenges to investment arbitration awards, apply and interpret the customary rules of state responsibility? Is there a noticeable difference between the practice of arbitral tribunals and domestic courts? Do arbitral tribunals/domestic courts follow and ICJ practice and the ILC commentary or do they significantly deviate from them? If so, do they do so across the board
or only regarding specific rules and specific topics? Has there been a change in the practice since the adoption of the 2001 ILC Articles?

Thematic Issue 4: State Responsibility and Compensation. Despite the fact that state responsibility and standards of compensation are a critical issue in contemporary investment arbitration there is still a great degree of uncertainty surrounding these topics. This is further exacerbated by the fact that a clear understanding of their normative status and interplay is crucial not only to the adopted litigation strategy, but also to the decision of whether to pursue litigation of a dispute at all. Within this thematic issue, we aim to examine a number of critical issues. Should the standards of compensation be perceived as reflecting CIL? Are the established methods of valuation, if any, norms of CIL? How do courts arrive at these standards, through an evaluation of state practice and opinio juris or through an interpretative exercise of a more general pre-existing CIL rule? Given the criticism of PCIJ and ICJ judgments on investment law (see, for instance, the debate on whether the PCIJ really applied CIL in the Chorzów Factory case) what is truly the content of the contemporary principles for damages and compensation that stem from CIL? In sum, which of the following are the methods that are applied in investment law? Are they an assertion, an application or an interpretation of existing CIL rules? Or are they perhaps something entirely new and beyond custom or even beyond law?

Thematic Issue 5: CIL and Execution and Annulment Proceedings Before Domestic Courts. The role of CIL in execution and annulment proceedings in domestic courts is the focal point of this thematic issue. Examining the practice of national courts and regional or country specific differences with respect to their approach to CIL and investment law will yield interesting results. For example, how do domestic courts interpret and apply CIL in execution and annulment proceedings? What different patterns exist and what are the reasons for such divergences (or convergences) of the national approaches? What is the approach of domestic courts to the elements of custom under international law? Are there differences discernible with regard to specific issue areas or with regard to specific countries?

Thematic Issue 6: TWAIL, CIL and International Investment Law. The questions to be asked within this thematic issue are: What lessons that can be learned from the Third World Approaches to International Law (TWAIL), e.g. which customary norms derive from the times of gunboat diplomacy and how has their continued relevance shaped the investment regime as it stands today? What are the regional differences regarding their approach to CIL and what can we learn from the diverse practice of various continents (in opposition to the Western-centric prevailing attitude)? For example, is there a regional Latin American CIL of relevance for international investment law and arbitration?

Publication

A selected number of papers presented during the Conference are intended to be included in an edited volume published by a renowned Publisher. To be considered for the planned publication the participants should send their paper (or at least a very advanced draft thereof) to the organizers before or on 1st September 2020. Selected applicants whose contributions
will be included in the book will be informed shortly after the end of the Conference, and should send their final version of the chapter no later than 1st November 2020. More information will be provided in due course.
Should the quality and interest in publication in the edited volume exceed the capacity of an edited volume, the option will be offered to publish some of the papers that will not feature in the book in a special issue on Investment and Custom in a well-respected international law journal.

National Seminar on Working Women in Unorganized Sector in India: Issues and Challenges, NUWUSI-2020

Theme

According to the National sample survey 2005, the contribution of female workers in the unorganized sector in 96% and they contribute around 20% in the GDP of India. Indian working women constitute nearly half of the total working population and their economic status is still low particularly of those who are engaged in the the informal sector or unorganized sector such as home industry, self employment, small units, agriculture, labor on construction sites etc. The major aspects of working women in unorganized sector include the terms and condition of employment, job security, earnings, social security perquisites, retirement benefits etc., and they are in a disadvantageous position. Some steps have been taken by the India government both at the national and the state level, to protect the rights of working women in the unorganized sector. Therefore, there is an urgent need to focus on and discuss the problems of working women in the unorganized sector. Thus, this national seminar is organised to highlighting the socio-economic condition of of working women in an unorganized sector and to develop the toolkit for improvement and implementation of government policy regarding the health, safety and overall well-being of working women in the unorganized sector.

  7. Labor laws of central and state government for the working woman’s in the unorganized sector.

The abstract of paper should not be more than 300 words and the full-length paper should not exceed 6000 words.The submission should be in Microsoft word only, written in A4 single-column format, 1.5 line spacing and normal margins, using the font “Times New Roman” in 12 point size.Keep the layout of the text as simple as possible. References cited in the text should conform to the style used by the American Psychological Association.

However, consumer trend have become more complicated and digital since then. With the advent of technology and specifically internet and e-commerce, the demand for newer rights and protections for consumers emerged thereby insisting on developing an inter-disciplinary approach towards studying and interpreting Consumers laws and Rights. This training programme-cum-workshop focuses on discussing not only the basic laws about consumers’ protection but also the latest developments and its inter-relation with other disciplines like technology laws, human rights etc.

The Centre for Transparency and Accountability in Governance (CTAG) and National Academy of Law Teachers(NALT), NLU Delhi are organizing a Seven day “Capacity Development Programme on Labour and Industrial Laws” (Dec 12-18, 2016).
The idea behind organizing this event is that Labour and Industrial Laws teaching in India generally lacks orientation and is also affected by curriculum issues, approach to teaching and standardization of course material. Labour and Industrial Laws in India is taught at various levels, which includes a few independent departments, or as part of teaching in law. This interdisciplinary subject has tremendous potential to contribute for policy and other applied objectives.

The Sambhaavnaa Institute of Public Policy and Politics invites applications for it summer schools on ‘Rethinking Development’.

The aim of these programs is to engage young minds inclined towards developing a holistic understanding of contemporary socio-economic-political issues.

The key focus is to critically examine the current notion of ‘Development’ that pervades popular imagination and public policy. The workshop through experiential sessions and collective dialogue provides an alternative and systemic perspective on socio-economic-political issues. The programs provides a window into the principles and strategies of various alternatives to ‘development’ – both at the grassroots and policy level.

1. Six week School (Classroom + Field Internship) 25th May to 6 July, 2016

This program aims to bring together theory and practice.  The 2-week classroom component of this program will engage the participants via interactive lecture sessions, group work and group discussions, film screenings, collective reflection, and most importantly, live experience sharing by activists in an attempt to build a holistic and interconnected picture of the issues facing our society today.  This 2 week classroom component is split into two parts: the first part at the start of the program focuses on theory.  This is followed by the field internship.  This is followed by the second classroom component which focuses on reflections, experience sharing based on the internship.

The 4-week internship offers a chance to work with and learn from well-known organisations that are engaged on the ground.  In the past participants have worked with Narmada Bachao Andolan (M.P.), People’s Science Institute (Uttarakhand), Mazdoor Kisan Shakti Sangathan (Rajasthan), Kheti Virasat Mission (Punjab), Hazard Centre (Delhi), Mahila Jan Adhikar Samiti (Rajasthan), Eklavya (M.P.), Jagrit Adivasi Dalit Sangathan (M.P.) and many others.

Program Fees: (a) Rs. 7400. This fee includes only the food and stay expenses during the classroom components of the program at Sambhaavnaa Institute.

Compulsory Exercise component of the application process

Please choose any one exercise from the three below and email your write-up (English or Hindi) to contact@sambhaavnaa.org with the email subject as ‘ND Application Exercise: Your Name’ latest by 25th April, 2016.

Exercise 1: Locate one person in your neighbourhood who is an ‘unorganised sector worker’, and interview her/him about the nature of their work, wages, family, who else earns in his/her family, the conditions his / her family lives in etc.  Why do you think people have to work in such conditions, and how do you think this can be bettered?  Write a report (not exceeding 750 words) based on the interviews.      (Please provide actual names, address and phone number (if exists) of the interviewees)

Exercise 2: Please find out about the lifecycle of the garbage generated where you live,  once it leaves your home.  Who transports it and how?  Where does it finally end up? What are the working conditions of the people who handle it?  What % is recycled?  Where does this happen?  Try to actually follow its trail and visit the facilities where it ends up.  Interview one person in the process and understand his / her working and living conditions and wages.  Write a report of your findings (not exceeding 750 words).

Exercise 3: Visit a government school in you neighbourhood.  Interview some students, one teacher or other staff about the working conditions, the outcome levels of students, the general infrastructure, and the general atmosphere in the school.  (Please provide actual names, address etc of the school)  Do a comparison with the kind of school you attended. Write a report of your findings (not exceeding 750 words).

THE AIMS OF THE PRESENT TRAINING PROGRAMME:

 To re-orient participants to the basics of Environmental Law and Environmental Management;
 To acquaint the participants with some of the latest happenings and environmental challenges of the country today;
 To update the participants international developments in the field

THE PROGRAMME – STRUCTURE:
To achieve successfully the abovementioned aims the programme is woven around two points; viz. • Practical Exercises: • Theoretical Expositions

TRAINING DISCOURSE:
The entire training programme is designed for 5 days. In the first stage of the programme the participant is taken to the basics and jurisprudential aspects of the subject. The second stage of the programme unfolds before the participant many contemporary developments in the area of environmental management both national and international. There are experts in the field of environmental management who will be invited to act as resource persons. In selection of resource person delicate balance between law academia, judges, activists and other academics is maintained to make the effort truly inter-disciplinary.

The Process: There are three methods adopted in overall conduct of the programme viz.
 Distribution of courseware (Reading Materials)
 Technical sessions
 Mutual Learning Sessions- Problem Solving sessions Courseware

(Reading Materials) Distribution: The basic reading materials are provided to the participants well in advance (in the beginning of the course while registration). The participants are encouraged to go through the same before attending the technical sessions (and through the course). To facilitate easy handling courseware is divided into three volumes. The courseware includes carefully selected writings of scholars indicating latest developments in the field of environmental law.

Technical Sessions: An experienced resource person is identified to talk upon a theme. The resource person is provided with overall structure of the programme and the composition of the group which he is expected to address in advance. The technical sessions are of 90 minutes duration. The mode of discourse is mix of lecture and discussion method. To begin with the resource person may give overall idea about the subject upon which he is to dwell, and then followed by free discussion upon the theme. There is sufficient scope for the resource person to structure these technical sessions to suit his subject. There are some technical sessions in which deliberately two resource persons are assigned the task. They being experts drawn from different areas will provide different view points to the subject matter helping the participants to know various angles of the matter. Mutual Learning Sessions: There will be ample scope provided for participants to learn from each others experience in the name of ‘mutual learning sessions’. Apart from their informal interactions with other participants (as they are housed in one residential complex) there is some formal ‘space’ provided for formal interaction as well. There will be a problem solving session as a part of this mutual learning process. The Participants will be given a set of practical problems. They will be introduced to library facilities for referring bare texts and vital resource materials to solve the given problems.

Formal learning sessions: These are formal and guided sessions, woven within the programme. The participants are informed well in advance to prepare a small documentation of environmental challenges of their locale and also some solutions if found by members of their locality. They are asked to share the challenges along with probable solutions etc., with other participants. The session will bring out to the fore the verity of environmental challenges and the possible solutions. The 4 participants will be able to understand gamut of environmental challenges and also learn from comparison with others experiences. The Knitters of the programme will try to put the entire discussions and presentations in a frame work. Finally all the deliberations are concluded by drawing some ‘take home points’. Informal learning sessions: All the participants are housed under one roof in National Law School of India University’s International Training Centre. The participants are given ample space to interact during their stay for three days, after formal sessions of the training programme. The hope is that such informal learning sessions will enemata some interest into knowing various varieties of traditional methods across the country to protecting the environment.

Vision of this training:

 To acquaint the trainees with the current developments and emerging trends in field of environmental law;
 To study, scrutinize and critique the existing system of law and governance at domestic level;
 To identify gaps in the translation and legal application of India’s international obligation keeping in mind the most prominent aspects of waste management namely, prevention, precaution, recycle and reuse;
 Legal and enforcement capacities of the law maker and enforcer/ PCB officials. Participants will not be provided TA/DA either local or otherwise. Participants must make their own arrangements for conveyance and travel.

The selection would be on a first come first serve basis. Five Day Training Programme on “Environmental Legislations, Interpretation and Enforcement”

The Centre for Environmental Law Education, Research and Advocacy (CEERA), established in 1998 is an integral part of National Law School of India University, Bangalore, a premier law university in the country. CEERA has dedicated Faculty Coordinator and fulltime core team of research scholars working all through. It enjoys the support of Ministry of Environment and Forest (MoEF), Government of Karnataka, Bar and Bench. Building environmental law data base, effectively networking between all stakeholders and build environmental law community and policy research are CEERA’s main objectives. To achieve its objectives CEERA ever attempts to build functional and professional linkages with government agencies and non-government organizations in India as well as South Asian region and at international levels. GNLU Intensive Training Program on International Ship and Port Facility Security (ISPS) Code

Aims and Objectives:

The course is of value to everyone assigned as a security officer who is responsible for overseeing fleet security and safety. This intensive course is designed to provide comprehensive knowledge of the Code to the port, company and ship security officers assigned with specific responsibilities under the ISPS Code.
